My BMW has the wrong seats - what can I do?

I bought a BMW 520d from Halliwell-Jones and have found the front seats do not have lumbar support. The BMW and dealer websites describe the car as having part electric seats as standard. The handbook shows both all electric and part electric seats. Both versions have lumbar support.

I have returned it to the dealer and following their answer that the seats are standard I contacted BMW UK. They tell me the same thing. The seats do not comply with the description in the handbook or the websites. Does this contravene the trade descriptions act and am I entitled to return the vehicle and get a refund?

The County Courts have ruled that cars manufactured after a brochure, handbook or other description was printed do not have to match the printed description. The reason is parts shortages. There are tens of thousands of components in a car and many cars are built to custom specs on the production line. If a part is not available, the line cannot be stopped so the car is built without it.
