Approved used car has no service history - what can we do?

My son bought a 2007 used Mercedes-Benz C220 CDi Sport from a main dealer in Aberdeen about six months ago. We have since discovered the car has barely any service history.

The first stamp in the book was at one year old from an independent garage somewhere in England, the second is at two years from an independent garage in Aberdeenshire and then nothing until earlier this year, when the selling dealer stamped the book just prior to my son taking delivery. That’s a gap of four years.

Before he bought the car he questioned the service and was told it had a full history. The dealer then said it wasn’t a problem that the book hadn’t been stamped, since all service records are kept on a computerised file.

My son likes the car and would like to keep it but is very concerned about having paid over the odds to a main dealer for a six year old car when he could have bought a similar aged and spec one for a lot less from a non-approved dealer. Are we entitled to any compensation?

Check the advertised terms and conditions of the Mercedes Approved Used Car programme. If you find that your car is in breach of these advertised terms and conditions then it is "not of satisfactory quality" and he can return it to the dealer for a full refund of the original purchase price on the basis that it was faulty even on the day of sale. The law is Clegg v Olle Andersson, House of Lords, 2003.
