Dealer won't refund me all my money for damaged car

I purchased an Audi A3 Quattro TDI recently for £6000. It has covered 80,000-miles and was bought from a dealer.

Within hours of buying the car, it developed a major problem and was sticking in 1st and reverse gear. I took it to a local garage and they said the clutch free wheel had gone and needed replacing - a job potentially costing over £1000. I spoke to the dealer and he agreed to take it back and fix it for me.

I had it towed back to him and he ‘phoned me to say that the damage was so significant it was going to cost him too much to repair. He offered me a refund in return for the car. I agreed.

However, he’s only refunded £5500. I rang him up and questioned him and he claims the car is absolutely fine, it is working with no problems and never had a problem. He said he will not refund me the full amount as he had taken £500 for admin charges, re-valeting and re-advertising fees and claims the car is absolutely fine and has NEVER had a problem! Where do I stand legally?

Use www.moneyclaim.gov.uk to sue him in the small claims track of the county court for the £500.

Tell him that is what you propose to do. If he knows about the small claims track he will repay you without going to court. If the case goes to court you stand a 90 per cent chance of winning.
