Dealer has changed the price?

My daughter contacted the main MINI dealer in Stockport and told a sales person she knows that she was interested in trading her Volkswagen Beetle against a used MINI One.

The brief was up to three-years-old with average mileage. She was referred to the dealers web site and in particular to a car just in but not yet valeted or prepared for sale on a 60 plate with 15,000 miles on the clock. She looked at the car which was priced at £7495.

A visit to the dealer was arranged and a short test drive took place. An offer was given for the Beetle trade in and all seemed well. She opted for the MINI finance to pay the difference between the trade in and the price of the MINI and was told papers would be e-mailed that afternoon.

When the papers came through the price of the Mini with road tax for 6 months was given as £9090 not the £7495 as in the advert. She checked the advert again and sure enough the price was £7495. She rang the garage to point out the difference and was told that this was a mistake and within minutes the advert for the Mini was taken down from the site.

Luckily she had printed off the advert. Where does she stand? Can we make them honour the price even though it was probably wrong? I think of the example where goods are incorrectly priced in a shop and in that instance the shops have to honour the marked price.

She needs to check her 'cost to switch'. If, say, they agreed £4,000 for her Beetle and £3,495 to finance, then the cost to switch was £3,495. If they have now upped the price of the MINI, they may well have also upped the price of the trade in for VAT accounting reasons. As long as the cost to switch remains the same, no problem.
