Why didn't this Peugeot dealer tell me that my Peugeot 207 had previously had a gearbox repair?

I bought my 2008 Peugeot 207 from Scott Darrington at Charters, Aldershot in August 2011 with a year's warranty. Two weeks after the warranty expired (Aug 2012) I noticed there was a problem with my gearbox – a clunking noise every time I went into the second gear. I contacted Charters, Aldershot and they stated at that time they would be unable to help me as the car was out of warranty. I took my car to my local Peugeot dealer - Chambers Group, Tamworth, to be fixed.

At this garage they found the second gear and the hub teeth to the first and second gear to be damaged. They also informed me that the gearbox had been dismantled previously. I asked Charters, Aldershot who I bought the car from and they confirmed this that the previous owner had had her gearbox fixed under warranty. I was asked why I had not been informed of this at the point of purchase and informed that this is not routinely discussed. The overall cost to fix my car was approximately £889.

After negotiation, Mark managed to get Peugeot to pay 40 per cent towards the cost of the repairs and Chambers Group offered 10 per cent towards the cost also. Mark suggested that I spoke to the Charters, Aldershot to see if they would help towards the costs. They said that they could not help but if I was unhappy to contact Peugeot directly, which I have done.

I have had to pay the remaining sum of £444. I have concerns as the car is only four years old with approx 56,000 mileage so why am I experiencing problems with the gearbox? I have also been informed that this is not the first time with this car that there has been a fault with the gearbox. This indicates to me that there is a manufacturing problem with my car’s gearbox but according to Peugeot's letter they state that they cannot guarantee the durability of the parts.

If you are not happy with the situation then sue the dealer who originally sold you the second-hand car with the faulty transmission. You can directly quote the Supreme Court ruling in Clegg v Olle Anderson (trading as Nordic Marine) 2003. The dealer sold you a car with a fault, which he knew about.
