Can we return our Nissan Juke for failing to achieve its quoted mpg?
My wife has just purchased a new Nissan Juke automatic 4-wheel drive from Charles Hurst, as her health dictates an automatic. Nissan states combined fuel consumption is 37.2 mpg and extra urban of 47.1. This we knew and accepted. With 300 miles recorded combined is recorded as max 29.6 with a long run of 185 miles giving only 31.1mpg, with two passengers running in "normal" mode. Charles Hurst advise to drive for 2000 miles and then let them have the consumption figures and they will inspect the car for any malfunction. I know the engine should give better figures after a run-in period, but by 2000 miles the car will be outside the one-month purchase return time.
My wife loves the car but if the figures do not improve significantly after 2000 miles we will not be keeping the car, but would consider changing to a Nissan 1.5 diesel Juke. What rights do we have now to return the car if it is not performing as stated under ideal conditions? What rights do we have after the 2000 mile period if the car is still under performing? What is the period of time allowed for us to have any comeback with Charles Hurst?

Nissan gives the EC lab test figures because they are the only figures that manufacturers are allowed by EC law to give. There is not and never was any guarantee that drivers will achieve these figures. So you actually have no grounds to reject the car. Go here: www.honestjohn.co.uk/realmpg/Results?manufacturer=...n and you will find that the real life average fuel economy for the Juke DiG-T 4x4 CVT is 31.1mpg. That is the average of what real people are really getting. It would be completely stupid to swap the car for a 1.5 diesel because the financial loss involved in doing this will be far greater than the financial gain from the improve economy of the diesel, which brings with it a lot of potentially expensive problems as well.
