Where do I stand on this warranty claim?

My Santa Fe broke down on the M5. It was taken to Hyundai Murley in Stratford. The cam shaft seized in the cylinder head. The car is still under 5 year warranty.

Hyundai has refused warranty cover over the past 4 weeks for the following reasons: The car was not serviced (yes it was - January 2013).

The service was not completed to Hyundai spec.
(Yes it has - written proof from Halfords showing specific Santa Fe service at 50,000mls).

Wrong parts used (invoice supplied showing my registration number and part numbers for oil filter and cabin filter).

Wrong oil used (Workshop (Halfords) internal paperwork supplied showing 5w/30 fully synthetic used).

Latest situation: Hyundai are now sending oil from sump for lab, checking to see what viscosity oil is in the sump.

Your comments would be much appreciated but I think you will agree Block Exemption is fine in theory but if a service is carried out by a non franchise dealer and a warranty claim does arise the manufacturer will try anything not to accept their responsibility.

The EC Block Exemption Rules only apply to the compulsory first 3 year warranty. They do not apply to extended warranties, which are a contract between the supplier of the warranty and the buyer of the extended warranty and are subject to terms. Hyundai believes you breached those terms. If the oil tests show that the wrong oil was used then Hyundai has no liablility.
