Who should cover these repair costs?

I have just bought a 10 year old 100,000 mile Audi TT 225 manual petrol quattro for which I paid £5350 cash from a dealer. Having taken delivery I now find that there are two split CV gaiters (one inner and one outer) the Engine Management Light has come on, the windscreen wipers do not clear the windscreen and the offside xenon headlight intermittently fails to light.

The car came with an existing MOT with about six months to run and no advisories. The car has done about 5000 miles since that MOT was conducted. The dealer says that because the MOT was in force he is not required to fix these faults.
I believe the car is unroadworthy and I am therefore entitled to return the car for a full refund or at least have these faults fixed at the dealer's expense. I have only had the car since January 30th and driven about 300 miles.

Can you please tell me which of us is right? In passing there are other issues to do with condition such as all brake discs being very badly dished and a leaking power steering box but I guess that, although disappointing, they have to be accepted on a 10 year old car.

Er, no. The dealer is responsible for these faults. Even though the car is high mileage and is 10 years old, the price of £5,350 is a full retail price and for that sort of money your friend is entitled to get a car in good condition with no faults that make it unroadworthy.
