BMW made changes to that engine in late 2007 that brought the emissions down to 119g/km. It has become common for manufacturers to make small changes to emissions so that they sneak in under tax bands. The downside is that existing owners are left with the original, more expensive to tax, emissions and it's confusing for buyers when the same car can have two (or more) different CO2 outputs.
