Problems starting an Avensis
I have a Toyota Avensis 2008 D4D model. It has only covered 32,500 miles but has developed a problem where it intermittently won't start and can cut out when driving - which is has done in lane 3 of the motorway.
I have taken the car to the Toyota dealer that I bought it from and they can't find the problem due to the intermittent nature.
I bought the car when it was 2 years old and it is now 6 months out of warranty.
In my opinion, this doesn't meet the durability criteria required under the sale of goods act as there is a reasonable expectation that a Toyota won't develop a potentially serious problem after just 4 year and 32,500 miles; so I argue that it is Toyotas problem to fix, despite being out of warrenty.
I have written to Toyota and am awaiting a reply. Do you have any thoughts on what the next step is? Do I have a leg to stand on legally?

Toyota is normally very good about this sort of thing so you can expect out of warranty goodwill to get it fixed. Toyotas now carry a 5 year warranty.
