Was there a contract, and can I get my deposit back?

I visited a main dealer this week. Told the salesman what I wanted - nearly new. He phoned me later, offering a car registered Feb 2012 with delivery miles, for £9999.

Yes please, I said, and gave my credit card details to pay a £500 deposit. I was told the car was coming from the manufacturers UK dealer website and would be with them the following week. 90 minutes later another salesman called. Told me that the car had been "lost" - another garage had bid on it.

But they would watch the site and call me as soon as. Shame I said.

But I was expecting I had a good chance to get similar terms on another car. Two days later I spoke to the first salesman who said "it was a misprice" - i.e. the price quoted was a mistake.

I don't know whose (theirs or the manufacturer - reference was made to it being theirs, having spoken to the national sales manager).

Having accepted their terms and given them a deposit do I have any right to require them to honour the terms they offered?

No, because they could not get the original car. Their bid for it missed it. They MUST return your deposit because they cannot honour the original contract.
