I received a reply from my MP regarding the Protection of Freedoms Bill.
I contacted my Conservative MP about Clause 56 in the Protection of Freedoms Bill as you suggested. His reply states they are aware of the problem and he claims safeguards will be in place to protect us from misuse of the scheme. A code of practice will set maximum levels of fines and a complaints procedure will be put in place. In a slightly more sinister vein, he states that if the registered keeper was not the driver at the time, the former will be able to give the name and address of the driver so the parking company can pursue them for the fine. He ends his letter by stating that this Government has promised to end the war on the motorist that existed under the previous administration.

I am fully aware of this cobbled up reply. It's a standard pro forma. What it says doesn't happen now. Not one reader has told me of a successful appeal or even of being made aware of the appeals procedure (www.britishparking.co.uk/Private-land). The only answer is to incorporate what was in that pro-forma letter into the Bill.
