Regarding motoring and the Magna Carta, I was looking at the court reports in our local paper this week and saw people receiving what amounts to warnings in the shape of suspended sentences for crimes such as shoplifting, assault as well as possession of drugs.

The largest fine by far was £525 with 6 penalty points (in effect a 3 year suspended sentence) and was reserved for failing to name a speeding driver to the police. Whilst it is the duty of us all to aid the police in their prosecution of the law, it is not our duty to incriminate ourselves or others without proof.

I have no problem with the police enforcing laws on speeding and indeed applaud all efforts, particularly near schools and in built up areas to control the irresponsible. I do however have a problem with the police suspending the rights of one section of the community by requiring either an admission or informing on possibly another member of the family to escape draconian penalties. (In case you're wondering I have not been summonsed nor has any member of my family but I hate injustice.)

Unfortunately, the Magna Carta was overruled by the European Court of Justice some years ago after a long and bitter battle fought by Idris Francis. The European Court of Justice preferred to make prosecutions easier for the police.
