Gearbox bearing failure on a C30

The main agent serviced my C30 under warranty. There is a whirring sound which has been diagnosed by two mechanics as coming from the gearbox.

They say a new gearbox is required. Mileage is less than 40,000 miles.

The whirring had been pointed out within the warranty period to the main agent who implied it was nothing to worry about.

It has, over time, gotten louder. The car is booked in with the main agent this week so they can diagnose the problem.

The warranty expired a year ago. If a new gearbox is needed what recourse do I have and can I hold the main agent/Volvo responsible for the estimated cost of £3,500?

Will be a bearing. But these are not covered by warranty unless they fail.
