My car hasn't been delivered yet

The order for my new car included a factory sunroof. The dealer subsequently advised that they expect the car on 31st March.

The dealer then advised sunroofs are a problem and delivery is now expected sometime in May.

The dealer has committed to hold the January cost to change as the delay is not my fault. There is no written order. I paid a deposit of £685.

I would be grateful if you can please tell me if I can cancel and seek refund of the deposit? In the exchange of emails I expressed disappointment about the delay to 31st March and when they advised May, I reminded them that at the time of ordering I sought a March delivery they have not challenged that.

If the factory is not building RHD Cruze models with sunroofs then there is nothing the dealer can do about this. See Johnson v HWM, Kingston County Court 1997.
