Fluid situation

I bought a VW Touareg on 24th April privately. The car had full VW service history and had only been serviced in February 2009. In respect of this we bought the car believing that it had been looked after. On the 11th June the engine blew-up and both the engine rebuilders and an independent vehicle inspector have confirmed that this was due to the fact that the wrong oil was used. I am in receipt of the last service invoice that states the type of oil used and this in fact is the wrong one. I am being told by the dealership that its just hard luck and that I am expected to pay for a replacement engine under my own steam. And that they have no liability since I didn’t get the car serviced by them, it was the previous owner. Is there nothing I can do to get them to pay, or is it just a case of finding another engine and never believing dealer service history.

I don't think so. Obviously if you bought the car from a dealer, then you can hold the dealer liable. But if he is a private individual you can't. You can't hold the servicing garage responsible because you did not pay for the service so there was no contract between you and the servicing garage. However, there was a contract between the previous owner and the servicing garage, so if you attempt to hold him liable, he can hold the garage liable.
