Insurance company has written off my car - can I demand its repair?

My car was damaged by another driver who immediately admitted liability. His insurers have taken on the claim but the repairs to my car cost more than they say it's worth. I've had the car from new and have had no problems with it at all. It has been a very good car for my family and I don't see why I should lose out. Can I demand they repair it?

No. It's very unfair, but case law has held that to "put you in the position you were in before the damage was done" all they have to do is pay you "market value" (private sale price) for the car. However, you might be able to negotiate to keep the car and be paid an amount to get it repaired yourself.
