Are Insurance companies getting lazy?

I have been told by Swiftcover that an accident I had was my fault, but they will not see my point of view and will pay out, then hit me with a premium increase at renewal.

It all stems from an accident in a supermarket car park. I stopped in a two way lane just past a car pulling out, when he had gone with my indicator signaling left and a clear road in front and behind I started to reverse into the space. While checking that my nearside was clearing the parked car another car came across the front of me and was hit as my front end continued to swing out. He had driven into a closing gap, and at no point before (or after) collision sounded his horn. When we got out he said I know you did not see me, you were looking behind yourself.

This to me says he was aware of what I was doing but still drove into a closing gap, yet this is still my fault how?

So is my insurance company being lazy and then just hitting me for higher premiums or is this my fault? I said i would like to go to court to sort it but they said NOT my choice because they had final say.

It doesn't really make much difference. If you are involved in any claim, whether to blame or not, you next year's premium will go up because you will be considered to be a greater risk.
