We bought a car that was listed with a full service history but that was false - where do we stand?

We bought a Peugeot 5008 April 2022, it was 13 months old and had 31 miles on the clock. Two months ago it broke down and we took it to Peugeot garage where they informed us it needed a new timing belt, although the car is out of warranty, as long as the car has a proper service history, the timing belt would still be covered as this has a 10 year warranty.

We then discovered that the dealership we had purchased the car from hadn’t provided that first service. Peugeot tried to replace the timing belt but in doing so the belt disintegrated and has now damaged the engine, so much so that the engine needs to be replaced. This is going to cost us a lot of money and it is not our fault. We have had a lawyer send a letter to the dealership but they have still not provided any service history for the 13 months before we purchases the car.

The bottom line is if the dealership promised the car had been sold with first service, we didn’t actually check this, we went on to service the car as and when needed, this catastrophic problem has occurred and is only covered if we provide full service history, but we do not have first service.

If the vehicle was advertised as having a full service history but this is not actually the case, then the car was not as described when sold. This would normally be covered by the Consumer Rights Act and allow you to reject the car or ask for a replacement - you can read more about this process here - www.honestjohn.co.uk/advice/car-buying-advice/how-.../ However, your rights are diminished as time passes, so the fact that more than two years have passed since you bought the car makes this less likely. If you have sought legal advice we would suggest continuing to pursue them in this way.
