Hi,

I was hit by a polish truck back in in december on the motorway. The damage was quite bad, as it took the wing mirror off, door handles and looks pretty bad. He came into my lane (coming from left to right).

I could not understand him and the motorway agency were called and took the information off him.

Called my insurance company and let them know I had been him, gave them the details I had. Got a call from a company who were going to deal with the incident, sort me a hire car out and sort the repairs out. However this is where the problem starts.

They had difficulty in finding his insurance (I had a policy number and address) another problem is that the truck had 2 insurances, 1 for the cab, and 1 for the trailer.

After much messing around, the assist company simply said they cannot do anything and just pay my excess. Now the solicitor that has been assigned my case (as I had to go for a medical examination etc) has come up with the same problem.

They have found the insurance brokers for the trailer and awaiting a claims handler to get back to her, however this all started on the 1st of December.

My question is...is my insurance company doing enough. It is such a hassle not having door handles on the passenger side as have 2 children and getting them in and out.

Any advice would be great.

Ahh hit by a truck from Poland rather than, as I assumed from title one with a cargo of Mr Sheen.

I thnk you need to lean more on the insurance company. Given the number of Eastern European trucks on our roads getting unsurance sorted cross borders must be a well trodden path.

Seperate insurance of tractor and trailer will be commonplace. In most of europe tractor and trailer have seperate registrations.

I wonder how many of these claims are resolved?

I commute the M20 in Kent. At least once a week, I see car and lorry drivers stopped on the hard shoulder after such incidents, exchanging details.

From my own experience, the (Hungarian) cargo company failed to respond to my insurance company. After 6 months the case was closed. The choice was to make a claim which would have been treated as an “at fault” one or fix the damage myself. At least my vehicle remained roadworthy after the incident.

I am surprised you were not offered the option of getting the vehicle repaired while the claim was pending.

Yes its an....experiance to say the least.

I wasnt offered a chance for the vehicle to get repaired as either the claims handling company (Accident 1st response) or the solicitor handing the case said they was a chance of them no getting paid. Also, with the car still being drivable it is not as important (however the car is/maybe illigel as there is no door handles on the near side of the car and most of the wing mirror is missing).

I am really pulling my hair out about this. If I pay my excess then its deemed my fault, which is not fair at all.

European registered vehicles have a representative in each member country to handle claims on their behalf.

Yeah thats the stage we are at. The solicitor has found the UK Representative, we are just wanting for them to accept liability. But I don't hold out much hope.

A bit late now for this case but worth following the advice given in the highway code not to travel alongside another vehicle on a dual carraigeway/motorway. This advice is also endorsed by the IAM and RoSPA. Wait until there is enough room up front then pass the vehicle as quickly as possible. By holding back you can also see what is directly in front of the vehicle as well so can tell if its likely to pull into your path.

On the motorway at the time, I was attempting to pass the truck, I always do, just a cautionary thing to do really, he just decided to change lanes unfortunatly. My lane was clear of anything and was at the time restricted to 40MPH due to an truck being escorted previously.

Bit gutted today, received a letter from the MIB to say that the Polish Bureau cannot find details of the cab registration...

Don't know what to do now...any ideas?

Ring the MIB and have a chat, you may be able to claim through the MIB under the uninsured drivers agreement.

Does the cab registration actually exist?

Hi Many thanks for that, the MIB are sending a claim form out to me, but I am within the 3 months of the accident happening....luckly.

Who knows if it exists, all I got was the trailer reg and the UK broker for them said tey cannot do anything without the cab reg..


Yet I have his address information policy number etc....Just not his green card number which is what I needed. But because I could not understand a word he said, the Highways agency took the information for me.
