Hi,

I have come out to find my bumber is hanging of on one side.

I noticed earlier there was a car parked very close to my car (we dont have marked bays)

Im certain who has done the damage but unfortunatly there is no CCTV evidence.

However, the person who own's the car has denied it and has told me to F-word OFF.

I dont want to make an insurance claim as my premiums are already high and it was not my fault. The only CCTV camera does have a picture of my car arriving for work undamaged which is good.

However, there are no signs up in my work place rejecting responsibility to car owners (the usual signs you see at supermarkets, etc).

What is my next course of action?

Do I go against the employee who's car park it is and is not displaying a 'we take no responsibility/owners own risk' sign.

Or

do I persue the individual but wiith little to no hard evidence?

Been there, seen it, done it. 1980s, MG Metro, company car park, effing great dent in the driver's door. I knew very well who'd done it......

Without a witness, you're stuffed as regards going after the other party. As regards sueing your employers for some sort of duty of care as regards the car park itself, you might get something there, in much the same way as they might be the sort who wouldn't bear a grudge come the next economically enforced cost-cutting time.

Secondhand bumper, grease the palm of a friendly local body shop bloke with cash and put it down to experience.

Im a contractor and my notice of service comes to an end next Friday so it wont really matter.

The question I have, if they have no signage up, does it make them liable considering I parked within their property and it can be proved my car entered their property undamaged?

But is the cost of a lawyer more than teh cost of the repair?

If you lose, you will end up paying both.

On the other hand, companies will pay up if the sums are small just to avoid hassle.

Speak to a Lawyer. A "Letter Before Action" is not expensive..

Maybe a long shot but why not approach the HR department. If the other person, presumably a company employee, was abusive to you on company property, either in the car park or in the workplace, a lot of companies would take a dim view. Dignity in the workplace springs to mind.

Unless you can prove that the company has been negligent in the design of the car park then you have no legal basis for claiming against them, otherwise you could drive around causing untold damage to other vehicles then claim it was all the owners fault.

The only time they are liable is if some part of the car park itself (i.e. a bollard or a sign) falls against your car and causes damage.

I would report the abusive language. Every workplace has a 'respect' policy. I think trying to persue the individual for costs with no hard evidence could end up costing a fortune.

Make friends with this person. Patch up your differences. Then go round to his house and sew a prawn into the bottom corner of each curtain.

It's to late now, but something very similar happend to me.

As with you there were no witnesses, however I was 100% sure who did it, so I bluffed and told them I saw them do it. I was very assertive and left him in no doubt that I'd seen it and I also suggested I would be reporting it to the police as he failed to stop after he hit my car. Again bluffing, but I felt that I had nothing to loose

However I was also fairly confident (within 10 mins) of when the incident would have happend.
