VW Passat estate - NIP - Zenergetic

My Husband has just received a NIP the original offence was dated 22nd August 2012 he has a company hire car. He had not heard anything so thought he had gotten away with it until he recieved a phone call from his company. He confirmed that he was the driver at that time. Today he received a NIP from a third party who had forwarded it to him that is dated "15th October 2012".

He was doing 61 approaching a 40mph on a bend & the manual device camera was just around the bend.

Are they allowed to retropectively change the date on a NIP & are their any rules governing where police can park when it is close to a bend 60mph going into a 40.?

Any advice would be much appreciated :-)

My understanding is that each time the NIP is returned with partial information, eg from rental company naming the company renting the car and then from them naming the driver, then the clock resets to zero in terms of serving the NIP and it's time limits.

The offence is committed at the start of the 40 zone - drivers are expected to be down to the speed limit at the point it starts - police can carry out enforcement anywhere within the limit area.

SFAIK the NIP has to be served within 14 days, either to the registered keeper or, in the case of a company or leased car to whoever "Owns" it. The key here is whether this is what happened. If the NIP missed the deadline it is invalid, in the same way as it would be if not delivered to a private and registered owner within 14 days.

In this case Company get Noip/172 and name driver and return.

NOIP/172 sent to named driver..

As AS states if original Noip not received by last post of 15th day (day of offence not counted in 14)

The date quoted by the OP, clearly after the 14 days, may not be the date of the original NIP - in the case of cars owned by rental companies, several successive NIPs may be necessary to follow the chain back to the driver.

The 15th Oct date quoted may simply be the date at the driver's employer - not the original NIP date to the rental company.

Don't give up, yet. Has it been established whether the NIP was served on the leasing company (or whoever "own" the car) within 15 days?. If it wasn't there is no case to to answer!
