Licence revoked - martin12

Hi there , I was wondering if anyone would be able to give me some info regarding what happened to me in the early hours of this morning on my way home from work. I was stopped by a police officer in a random stop and check and after confirming my details the officer informed me that my Licence had been revoked back in 2003 and I was subsequently charged with not having a licence and therefore my Insurance was invalid so I was charged with that too. They were going to impound the vehicle but must have seen the state I was in after hearing all this and allowed my Girlfriend to come and pick me up as long as she drove the car home. I phoned DVLA and they informed me I hadnt surrendered my licence for endorsement at the time of a speeding penalty.They said I would have to have it replaced(my photo licence is up for renewal in November this year )and could only give me the date of the last time they had heard anything regarding the endorsement which was May 2003. The only time I can remember any speeding incident was in Blackpool and when I received the notice I remember filling in all my details and admitting the offence so included the fine.From reading some posts on here it looks like I should have sent my licence away aswell but I didnt as I cannot remember (at the time) the letter informing me of that. Going from memory as it was a long time ago , all I done with my response was fill in the form admitting the speeding , filling in all the details from my licence , and sending the payment. The DVLA gave me a number in Blackpool to phone which I have tried but after putting me on hold it just sounds off (i'm frantically trying here as I type!) . The police officer this morning told me to seek legal advice aswell regarding the charges they gave me this morning so I was hoping someone would be able to tell me what to tdo next as I desperately need my car for work and picking up my Son who stays with me every weekend.

Hi again , I have since been told by DVLA that as my photographic licence is due to expire all I need to do is renew it which I'm off to do just now. I also manged to get through to the Lancashire Constabulary Office but they could not find or had any details as it was so old. They told me to phone the courts which I have done and I was asked to email them with all the details and they would get back to me with any info. All this is good but Lancashire Constabulary told me some things which do not add up and I was hoping to try and seek some advice on the matter and until things are identified I have still been charged so am unsure as to what my next step is ? Thanks in advance for any advice offered.

When you are reported either by FPN, CO or Court Summons for an endorseable offence i.e. speeding in addition to fine etc you HAVE TO surrender your Licence for those magical points to be endorsed on the Driving Licence.

DVLA are informed of the endorsement so that the Driver's Record can be updated and a record of the conviction/points awarded made. They are also informed whether or not the Licence was surrendered or not.

If not then they can and do revoke a driving Licence and as I understand it send a letter to that effect. This action means that if stopped then one is not driving under the terms of a Licence - an offence which appears is the only one coming to light from the stop. .

The part about the revoked Licence cancelling the Insurance is BALONEY. If you look at your certificate it will state that the Insurance covers " A person who holds OR HAS HELD A LICENCE TO DRIVE." One must therefore have held a Licence for it to be revoked.

To renew a revoked Licence in these circumstances all that is required is to renew which DVLA have advised.

Hanging is for more serious crimes...

Cheers for the info dvd ..I have now received an email from Blackpool court saying I had paid the fine in full ...this is the same date as my licence was revoked? It also states that I would have been sent a court fine letter if they didnt have my licence and also that DVLA would have written to me to send my licence to them to be endorsed. I know now from searching these forums that I shouldve sent my licence to DVLA but I never had any written requests regarding this or any from the court? I cannot remember all the details as it was so far back but cannot understand why I would pay the fine and not send my documents ....this is still puzzling me.

I don't know if its because Scottish Law is slightly different from English Law but my Local constabulary still charged me on both the licence and Insurance.....I will need to check my Insurance documents ....once again , many thanks with your reply
