I have just purchased a used Kia Ceed through a car dealer, the vehicle is a '10 reg. I thought it might have a few problems, clutch engages very quickly, white smoke from exhaust on cold start, slightly crunchy brakes, so I took it into my local KIA dealer to get them checked out. They tell me that it needs a new clutch, new front and rear brake pads and new fuel filter, about £1000 to repair all. I've called the dealer I bought it from trying to state my statutory rights but he says that these are wearable items and as they worked when I drove away then he can't help me! Do i have any comeback?

IMO He's right they are consumables. Down to the purchaser to do a test drive and walk if it's not right. Good choice of car though.

Sadly, if you'd bought a Kia C'eed with proper maintenance history you'd get the balance of Kia's 7-year warranty - ie another 5 years of manufacturer's warranty - but they don't cover wear/tear items either, I don't think any warranty covers that.

3 month warranty is a red herring unless its gone over 100k, the cars still under makers warranty...unless lack of servicing?

Good thing is you'll be able to do the brakes and filters yourself for under £100 the lot, and maybe the clutch too for around another ton or so.

Unfortunately you appear to have bought a car from Arthur Daley. We have a Ceed SW and its a great car. Brakes are items that wear out and are not covered by the Kia warranty, clutches are wear and tear items as well but sometimes there is hope if its clear that it was a manufacturing defect.The Ceed Diesel should be serviced every 12 months or 20,000 miles which ever comes up first, think the petrol is 12,000 miles or 12 months.

Why on earth did you buy the car and not get the "dealer" to sort it before handing over any money. I am staggered that there are still people out there who are happy to simply hand over cash for faulty goods even in these desperate times.

As a 10 plate car you should find out from Kia UK if the manufacturer warranty is still valid. These have a 7 year warranty so it could prove very valuable both in terms of future problems & resale value.

A 2 year old clutch, pads & filter will be wear & tear items & so you cannot expect Kia to pay for them but ........

..... assuming that "just purchased" means in the past few weeks then the supplying dealer is responsible for fixing them.

Under Sale Of Goods Act, faults occurring prior to 6 months of ownership are deemed to have been present at purchase unless the retailer can prove that they were not.

The only problem is that if the retailer refuse then you will need to go to court.

Clutches and brakes are always a nightmare to argue.

For example, for 7 years on the trot up until 2 years ago a group of freinds and me would buy a car and take it straight to the Nurburgring.

A couple of them came back absolutely thrashed to death with slipping clutches, brakes which had caught fire, basically very abused by 4 blokes racing it for 3 days.

In our case we always bought at auction and resold at auction (pity the poor buyer but hey ho) but had we bought at a dealer would we have been right to take it back and demand new clutch and brakes?

That's all very well but you'd need to argue that brakes and a clutch were not wearable items and you haven't used them in 6 months. They are and are not even covered under a new car warranty.

However, obviously if it packs up down the road from buying it, that is slightly different!

I agree that the items the OP mentions are wear and tear items, but when buying from a dealer, the product, in this case the car, should be "of merchantable quality", i.e. of a standard a reasonable buyer would expect given the car's age and mileage.

I don't think you mention mileage but the car is 2/2.5 years old and I would argue with the supplying 'dealer' that you have a right to expect the clutch/brakes to be in reasonable working order and not unsafe.

My advice - if the supplying dealer absolutely refuses to budge, have it all sorted at the Kia garage, then inform Trading Standards and start court action against the supplier to claim the money back you spent putting it right.

Always check service history and drive properly before buying, if possible check with previous owner for any faults before parting with cash (I always insist on seeing V5)
