Citroen Xsara - Parking Charge Notice - tahinie

Please advise. I have received a Parking Charge Notice (PCN) from a company called VP Parking Solutions Limited on 25th April. They state I breached terms and conditions and requesting payment of £70.50 within 28 days or £50 within 14 days. I ignored this letter. Since then I have received 3 more letters. The latest letter dated 26th June states Debt Registration Northampton County Court.

It goes on to say in the absence of any payment in regard to the oustading debt relating to the Parking Charge Notice xxxxxxxx, I write to inform you that the charge has now increased to the full amount of £94. If your payment of £94 is received in full no later than 10th July 2012, no further action shall be taken. If your payment remains unpaid after that date, I will register the debt plus all costs incurred in the recovery with the Northampton County Court. Should a judgment in Court be made agaisnt you in this matter, it may lead to detrimental information being registered against your name and address with UK credit references services.

I am very upset by these letters and I am worried I will be atken to Court especially Northampton as I would not be able to attend (too far). The parking ticket I received in the post states Car parked not correctly. This is because I did not park in a space painted with a white line, I parked my car in a space available making sure I was not obstructing in any way or parking on yellow lines etc. Please advise. Tahinie

Citroen Xsara - Parking Charge Notice - Dwight Van Driver

Read:

http://www.tinyurl.com/2hr37d ......especially the part at Contract law.

To obtain any fee they will have to prove who the driver was that entered into the Contract.

It is against HIM any County Court action has to be taken.

Unlike Road Traffic Law, there is NO obligation on the Registered Keeper to name the driver.

Has VP the details of you of the driver?

One has to consider that these people write agressive letters threatening all kinds of action that they are not in a position to take. Are they going to try and take action?. I cannot answer but if they do take it to County Court to get a judgement they will have to prove who the driver was and also that the charge was fair.

Up to you to acceed or ignore totally any correspondence from this firm

Assuming this is private land ot looks like a contractor trying to confuse/intimidate.

Local Authorities can register unpaid PCNs with the traffic enforcement centre at Northampton County Court. The court then sends notice of registration and unless there are grounds (no prior notice; appeal in process or similar) that's enough authority fro a bailiff to be instructed.

On private land they'd have to issue a default summons. When this arrives it's pretty clear what it is. Northampton is likley to be the venue as it's the bulk issue centre for thw whole of Engalnd and Wales. Defended cases should be transferred to the defendants local court if there's a need for an attended hearing.

DVD advice is as ever spot on - ignore.

Ahh, the old trick of using a Court Service form as a frightener. Same thing used to happen 25yrs ago when I worked for the Lord Chancellor's Dept in a local court. We used to send those drawn to court's attention to HQ, IIRC LCD took a dim view.

Going back even further, when debtors could be subjected to a judgement summons with possible time behind bars for debt, one of the TV rental companies was exposed by Which? as using JS request forms in this way. Known in the trade as 'blue frighteners' after the colour of the form.

Citroen Xsara - Parking Charge Notice - concrete

Hello tahinie, please do not be worried or upset by these sharks. They are only trying it on. There is no debt until AFTER a court hearing and a judgement against you, so fear not. Poatage stamps are cheap and so are threats so just completely ignore them. It costs a lot of money to go to court and you have more chance of a ride on Flipper than being taken to court. I have crossed swords with these b@st@rds in the past and I can send some copies of letters that would frighten Batman. DO NOT part with any money or contact them in any way. They will go away when they get fed up of being ignored. However, come the revolution and the Protection of Freedom Act is passed then this get out will be unlikely to be available after October 2012. So be extra careful in future. Good luck. Concrete
