Hi all,

This is my first post on here so bare with me please! Quick question to start me off: Recently picked up a parking ticket, obviously not very happy. The thing is that the double yellow lines I was parked on were very much in a state of disrepair and barely visible. Do you think this is reasonable grounds to dispute the charge?

You can try a polite letter to the local authority, but as you yourself could see that they were double yellow lines, I wouldn't be very hopeful if I were you. Wasn't there also a notice on a post nearby?

Hello Ewan, welcome to the forum. I presume the ticket is a Penalty Charge Notice and not a Parking Charge Notice. Big difference. If so then you can only rely on their appeals procedure. In which case you need photographs of the yellow lines to illustrate how their visual effect has diminished. Another exercise is to examine and photograph any signage which indicates parking conditions and restrictions and to check with the relevant bye-laws to ensure these are correctly displayed in terms of height, frequency and clarity etc. They might say that even if the lines are faded the signs should have been obvious to you. The appeal will have the effect of suspending the fine until a decision is reached. After that I don't know if the early payment option will remain open to you. You will have to check the ticket or appeal documents to establish that. Let us know how you get on. Good luck. Concrete

In relation to a Waiting Restriction (DYL) there is an obligation on the authorities to sign this in accordance with diagram 1018 contained in the Schedule to the Traffic Signs General Directions 2002 to make them lawful.

Yellow lines have to be continuous without breaks and obviously visible. In your case, it seems, this is open to arguement that the lines do not conform.

As stated suggested you photograph the lines in question and send a letter to the authorities to the effect as mentioned in the first para above.

It may well be, if they do not accept your arguement, that they will reject your submission in which case it will be up to you to take further to the Parking Adjuduicator (free and all explained in Notice of rejection.)

As mentioned above the PA's have found that if the lines clearly indicate to a normal person, a restriction, despite not fully conforming to the Regs then they have been held to be legal.

I agree. Would Ewan have parked there if the lines had been so conspicuous, I think not. The benefit of the doubt would be nice, but we all know what 'jobsworths' are like. Concrete
