We bought a car privately in November and have had constant problems. Does the sale of good act protect us even if I can't prove the faults were present when purchased? I think the faults are electrical.

Generally speaking the sale of goods act doesn't cover you when you buy privately.

The only time you can make a claim is under the misdescriptions act of 1967.

For that to be viable ,you have to be able to prove that the seller deliberately mislead you about the car.

For example, did he say the car had a new alternator fitted 2 months ago ,or a new windscreen wiper motor fitted. If you can prove that he lied about what had been done to the car ,then you may have a claim ,but it's a slim chance.

It also depends on how old the golf is ,if it's more than 7/8 years old ,it's unlikely that the courts would find in your favour .

It's a long chance ,but if you're based in west Yorkshire ,I have a fantastic auto electrician who works on my cars ,I don't think he would travel beyond west Yorkshire ,but if you need his number ,let me know .

Good luck

If you buy a car privately you do not have any protection from the Sale of Goods Act in any form unless the car offered for sale was misrepresented, ie described in the advert as reliable and it proved not to be so, economical and it wan't etc etc, regularly serviced and it turned out that it wasn't and so on. The problem that the average private punter will have is proving to a small claims or county court that what they have bought is not what was advertised. In a nutshell-don't buy privately, you haven't got any realistic hope of any comeback if things go pear-shaped.

Focused,
Don't buy privately ? I buy all mine privately ,their much cheaper ,just be cautious and do the proper checks.

Economic and reliable are subjective descriptions ,in other words a matter of opinion ,they could never be subject to any form of warranty or claim.

Tony g-

I haven't got the patience to mess about with the usual private sale rubbish-I usually buy 6 month old ex-demonstrators from a bonafide dealer.

Private sale motors are cheaper and you pays your money and takes your pick-either you buy from a dealer and you have warranty/comeback or you buy privately, save money but you are on your own-personal choice.
