The driving licence trap: 1.6m drivers at risk of £1,000 fine

Here's another nice little earner for the DVLA.

Over 1.6million drivers could be at risk of a £1,000 fine because the photograph on their driving licence has expired, a Freedom of Information request has revealed.

Sainsbury’s car insurance discovered that many motorists are at risk of a hefty fine because they may not be aware that a photograph on their driving licence needs to be updated every ten years at a cost of £20, as set out by the DVLA. Those with old-style paper licences are not affected.

As well as 1.6million drivers’ photographs that have expired, a further 2.9million must be renewed by the end of 2012 - and over the next five years, almost 13million drivers must renew their photograph to abide by the law.

Unlike the earlier paper licences which expired at age 70, all the photo licences were only ever valid for 10 years.

That's why many of us old fogeys are hanging on as long as we can before getting a new-fangled one with a picture!

I'm sick of all this 'grandfathering'. If a rule is going to be applied, it should be applied across the board, not just to those that are too young to vote at the point of its implementation.

There are many aspects of life for which "grandfather rights" are the only practical approach.

If you applied the same principle to vehicles, all older cars should be converted to Euro 5 or scrapped - not practical is it?

I perhaps would have a requirement for drivers to sit the latest driving test on a 10 year basis. I don't think it is impractical.

Grandfather rights only apply to that vehicle-not the driver. Older cars tend to have a higher turnover than older drivers so it is less of a concern.

The disparity between a pre1997 driving licence and a post-1997 licence is not trivial. To add insult to injury those with the restrictive licences generally had to undergo more rigorous testing.

I'm only aware of the B+E heavy towing entitlement being carried over for pre-1997 drivers because it affected me - I'd have taken the +E test if required, indeed will take it if the Euro-licence arrangements outlaw grandfather rights.

I know that goods vehicle entitlements change regularly but since I don't even use my C1+E I've not kept myself informed.

One of the things that could be done is for car and motorbike drivers to provide an up-to-date optician's test report every 10 years - many people are too vain to have their eyes tested and don't appear to notice the gradual deterioration which we all get to a greater or lesser degree. It won't stop people driving without their prescribed glasses but that is routinely checked if the police are called to an accident.

Good idea from RT re opticians test report. It would be relatively easy to implement, and not cause a big back-log that re-tests might produce ...

Oh, and like RT I've just stuck with a paper licence ... and I regularly hire cars at home and abroad, so it's no big deal ...

My photo licence has, at 4a a date of effectiveness and at 4b a date of expiry - there isn't anything about the date of the photo. Perhaps as I am over 70 and have to renew every 3 years, with a new photo(?) photo expiry does not apply to me?

The photo licences expire every 10 years up to age 70 and then every 3 years over 70 - mainly so you have to complete the medical declaration at 3 year intervals.

Plus, I think, a £20 renewal fee every 3 years and a new photo in circumstances which I haven't been able to establish! I must get onto the DVLA site!

Been trying to reply but for some unkown reason HJ site not accepting so trying AGAIN

I posted originally as a reminder to the large number of drivers who seem not aware of the 10 year rule. I think it is to assist the 'authorities' (also the coffers of DVLA) as the mug shot of a young debonair fly boy on RAF1250 now bears no resemblance to that seen in the bathroom mirror if you get my drift.

If it helps:

Section 99(2A) RTA 1988:

Licence comes into force:

any such period shall begin with the date on which the licence in question is expressed to come into force.

[and (ignoring the coffin dodging renewal)]:

a licence in the form of a photocard remains in force for a period of more than ten years, the holder of the licence must surrender it and its counterpart to the Secretary of State not later than the end of the period of ten years beginning with—

(a)the date shown on the licence as the date of its issue, or

(b)if the licence was granted by way of renewal or replacement of a licence bearing the same photograph, the date shown on the earliest licence bearing that photograph as the date of issue of that licence.]

Thanks DVD. I get the impression that I am in for £20 every three years. The photo can be electronically retrieved from one's passport, if it is less than 5 years old and both mine are over that!

As an aside, many major Post Offices now have a photo booth where, for a fee which includes Check and Send, they will take an approved photo and electronically transmit ti to DVLA to go with one's application

Good Morning Legal Eagle - call me Bleriot! I went thru the DVLA site but more looking at the photo regs than the renewal charges. I will look again. Thanks for your input.

Have checked = No fee. Does renewal mean that my expired points will be removed free BTW?
