Jaguar X-Type - Do i have a claim - bpmservices

I bought my Jaguar at the end of July of 2011 for £6000.00 with an advertised 89k on the clock. I mentioned to the dealer that it actually had nearly 92k on it but they just shrugged it off. I did buy the car though as it was what i wanted spec wise.

After having the car for about 3 - 4 weeks i had to take it to the garage because of a rear flat tyre. They replaced the tyre but said my front passenger tyre was illegal. I got the mechanic to speak to the dealer who asked me to bring the car back. My mechanic said he could replace the tyre as i could not drive the car as it was illegal and that i should bill the dealer for the £50 it cost for a good part worn tyre replaced.

A week later at the end of august i was driving to Dorset on my holiday. After about 50 mile the cars engine lost power and then cut out. I did manage to get it started and all seemed fine as we drove 600 miles for the week we were away.

Around Mid September my wife was applyimg for the tax online as it ran out end of September. It said that the MOT had run out in early august only 3-4 weeks after i bought the car. I was under the impression that it had a full MOT as it was from a dealer. I took the car to the garage again for its MOT. I got the MOTand service and re-taxed the car ok.

Shortly afterwards the car lost power again and then started cutting out altogether. I took it back to the garage again where they reported that it needed to go to an injection specialist as it wasnt indicating any faults on the ECU. I took it to the specialist who also reported no errors on the ECU and they replaced the air intake pipes at a cost of £180.00. The next day the car cut out again and got worse when mainly turning right hand bends. I took it to another garage who Tested the electrics but reported no faults again.

Finally I have taken it to a fourth garage that was recommended by an experienced deisel machanic, This garage sent of the fuel injectors to a specialists who have reported that they are all faulty and it will cost me £800 - £1000 to have them replaced. He also said he could not guarantee that this was the only problem and that once the injectors were replaced that there maybe other problems.

How likely is it that the injectors would all fail after 2 -3 months of having bought the car. plus only having 3 weeks worth of MOT. Plus the illegal tyre when bought plus wrong milage advertised. Can i claim against the dealer who basically has sold me £6000 worth of crap. HELP HELP

PS the car came with only 30 day warranty.

Hi bpm,I think their are two separate issues in your post ,

First, you were negligent in your dealing with the garage, how difficult is it to check how long the MOT is on a car.Second tyres ,it's easy to see whether tyres are legal.Third the mileage. You knew the mileage when you agreed to buy the car.
These are all issues that you should have resolved with the dealer before you agreed to buy the car.

With regard to the potential injector problem ,you may have a claim.Have you contacted the dealer. It's generally considered that a dealer is responsible for mechanical failings on a car for a maximum of 6 months after purchase.

However the age of the car and the mileage are taken into account ,you don't mention the age of the car , but it has done over 90,000 miles ,that would weaken your claim against the dealer.
If the dealer is unwilling to help ,you
could pursue him for the cost of the injector problem through the small claims court .The cost of issuing a claim is approximately £150.
You would have to have to have the problem rectified and have invoices to show the court the value of your claim.

Please let the forum know the outcome of your problem.

Hi Reply appreciated.

Firstly. I just need explain that when my wife and i were buying the car we were seriosly rushed in our decision as the sales person offered a £1000 on our old car as a trade in if we bought there and then. I did check the tyres and all appeared ok but i didnt have a gauge to test. (iam not a mechanic). Looking back we were pressured by the salesman and put that down to overlooking the MOT but you would fully expect all details to be apparent and made clear on all cars, especially when it comes to the MOT which idicates the cars roadworthyness. The salesman did not in anyway give out any important details freely, thus possibly keeping back important information. Its not the case of knowing or not, its the fact that they were selling a car that was not road legal and potentially lethal for anyone driving it as the salesman was as a runaround as he admitted. I soaked up the cost of the new tyre and MOT situation but now what with the Injectors etc, its obviouse the car was not fit for purpose. I will stick to facts and will not exagerate any reasons in my pursuance to get this situation rectified at the cost of the dealer. I have today been told by PF JONES, a diesel specialist that the Injectors, fuel pump and fuel tank may need replacing at a cost of upto £3000.00. Therefore a problem that would have started before i purchased the car and down to poor maintenance whilst in the dealers posession.

I called the dealer today and ask for customer servicesdept but was told they dont have one. The guy said he would inform the line manager and he would call me back in 10 mins. THEY DIDNT CALL BACK.

I will be calling them tomorrow. Lets see what excuses they come out with.

Many thanks

Hi bpm,
It seems that you have had a hard lesson from the rough end of the car retail trade.
A couple of things that may help, first don't expect the dealer to return your calls, that's normal.!They are working on the basis that you will loose heart ,and stop calling.
Instead write to them with a recorded letter setting out your claim ,tell them that if they do not respond within a fortnight ,you will issue a claim through the small claims court.then do it.

The important thing really is to get your car back on the road at minimum cost.
Have you looked at alternative suppliers for the parts you need ,try e bay for the injectors you need, parts from e bay can be much cheaper than other suppliers.Injectors are not that difficult to fit ,a good local mechanic can fit a set in less than an hour.if that doesn't work you can move on to the next problem.although it's very rare for a diesel fuel pump to fail.

Good luck.

OK, you have been robbed but that is an unfortunate fact when buying used cars with a high mileage from what would appear to be a Arthur Daley character.

My best guess would be that the previous owner knew all this and was the reason for him swapping the car. The dealer may well have been unaware of the problems (sellers do withold facts you know) but this should not prevent him from being a decent person but even though the trade has a better reputation today than it did years ago there are still plenty of sharks out there.

Simple fact is the X Type Jag is a Mondeo in a Saville Row suit thus you should be able to get it fixed for Ford prices and not Jag prices.

Get it fixed and take out a small claims court case against him if you want to get some money back, think its £150. You may win, you may loose, you may also get a load of heavies turn up on your doorstep.

I would suggest the mechanical problems are to do with the EGR valve and the electronic turbo actuator a well known fault with these engines as for the the other problems you have only your self to blame.

Having owned an X type I can offer some advice.

I WOULD NOT buy injectors from ebay. You are best buying brand new injectors from either Ford or Jaguar. When I though i needed some, I could get brand new ones (not reconditioned) for £180 each plus vat.

They then need coding into the vehicle.

Why have you been advised you may need a new fuel pump and clean the tank out? This may be the case, though not necessarily - you should seek clarification on this.

As one other poster has commented, it could be EGR or turbo actuator, though these would normally put a fault code which could be read.

Is yours a 2.0 or a 2.2?

Mine is a 2.2 and I am currently rebuilding the entire engine due to an injector fault, so be careful with them.

sorry I cant help any more.
