I received a Fixed Penalty Notice from the police on 9/5/2011, however the date on the ticket stated 9/5/2010. I asked the police if this invalidated the ticket; it does not, and I still have to pay. The only other option is to take it to court.. Do I bother? I'm a student so a £30 penalty is a lot to me! Police officers should not be making mistakes like this!

No they shouldn't because they are perfect like you who got the ticket in the first place whether its legal or not I wouldn't no.

I was actually parked legally, in a bay, with a permit. I just thought that fact that the date is a year out was more important to appeal in court.

The ticket untidily states; 'Limited Waiting Time'. There are 2 bays, one for residents, and one which is 2 hours only, between 8am and 6pm. My vehicle was mostly in the residents bay, and slightly edging into the 2 hour bay. This is the only reason I can think of. But if there is nowhere else to park, what else can I do?

The signs are unclear and the road markings are faded. I've taken photos of everything, the car, the position, the signs, and the road markings. If I go to court and lose, I will be charged court fees. I'm not sure if it's worth it? Police issued me the ticket, it is headed 'Fixed Penalty Notice'. The court aren't even willing to let me pay the penalty in installments. There seems to be no negotiation whatsoever.

The date on the ticket can be corrected up to court and will make no difference to the offence. Are you a resident and did you have the proper pass displayed?

If this was FIXED PENALTY TICKET and not a PENALTY CHARGE NOTICE or its nasty brother PARKING CHARGE NOTICE ( check this site for more deatails on this) then if it was for an endorseable offence if not paid the matter will go to Court where the defect will be amended, likewise if you please NG and try and fight. If it is for a Non Endorseable offence and you do not pay the amount will be recorded at Court as a sum in default and thereafter enforced as a fine.

Surely the key to your problem is beaing parked in 2 bays, each with different conditions? I think you will have to pay.

If they say you're doing something in 2010, which you ain't, tell them to stick it.

Their facts are wrong so just say no, courts work on facts so if their evidence is wrong you should go to court.

Offer evidence that you were elsewhere a year ago.

Wrong. They can change the details up to the date and time of the hearing particularly if there is a clear clerical error.

Furthermore the OP would be risking the court''s ite for wasting the magistrates' time and may suffer a higher penalty as a result (along with the levy for crime victims and also court costs).

If he wants to defend it then it has to be on the basis of no offence being committed, not on the "wrong date" issue.

Frankly I don't believe a word of this Lucy. Surely it would be the other party who are wasting time if you were in Majorca at the time. If the magistrates have become no more than a rubber stamp there's no hope left.
