Audi A3 - Licence Revoking-Court not advising DVLA - leannesalmon

Hi,

I am wondering if anyone can give me any advice on my licence being revoked. I was stopped yesterday morning by traffic police for using my mobile phone, normal procedures was about to happen until they checked my name......to then tell me my licence was revoked in 2008 for not surrending my licence to the court. I had no memory of sending my licence off but said I wasnt aware, the police advised that maybe I had a postman that doesnt deliver!!! I said this could not be the case as in May 2010, I was stopped(again for mobile) and they checked my name and issued the ticket and I left.

The traffic officers explained that for 3 years I had been driving with no licence, but was also confused about the penalty issued last year, after nearly 3 hours.....no dvla liason officer available, and a call to the court that issued the points in 2010, they "assumed" it was overlooked last year and therefore seized the car. I explained that its a company vechicle and that I could have someone with us in 10 minutes (half way through not at the 3rd hour), to which they refused and took the car.

Having been left in the street, extremly confused, concerned that I had been illegally driving for 3 years and would def lose my job, I made my way home. Having got home I looked at my licence to discover their are 3 points on the licence in 2008. I called the DVLA this morning to discover this is for offence and this is the reason my licence was revoked!!! I have now faxed my licence to them, once they see this they will update the sytem!!! In the mean time I had to inform work to get someone to collect the car, pay 170 pound, take 2 days off of work.

I am certain in the next few days that I will be able to drive again, but I have the following questions:

How to I guarantee from the dvla its been updated before I drive

Why the officers in 2010 never seized the car

How I get my money back and how i ascertain if it was the court not informing the dvla or the dvla not updating the system?

I am outraged at all the above and was made to feel like a criminal yesterday.

Thanks

We have had a number of similar cases recently.

There is no fault on the part of the officers confiscating the car - as far as they were concerned you were not entitled to drive.

I need to get a member of our speciailist motor offence team to go through this with you, Can you email me your contact details (name and telephone number) to asklucy@honestjohn.co.uk

It should be added that if you hadnt used your phone whilst driving you wouldnt of been in a predicament anyway ! I can sympathise with the DVLA mix up and yes its aggro, but there again if you hadnt been using the phone ! especially as you have been caught before ! obviously the points are not enough of a lesson ! The police officers were just doing their Job ! in protecting those of us who drive around without using the phone.

Were the 3 points in 2008 in fact your second set of 3 points. If not, why was your licence revoked in 2008. Or are you suggesting that the licence was incorrectly revoked in 2008 with only 3 points on it. Regards Peter

The points in 2008 was my first lot of points, the licence was incorrectly revoked. The court have sent me the details of when they advised the DVLA and are saying that it is the DVLA who are to blame.

Thanks

I understand that I should not be using the phone, and of course have learnt a major lesson. However in this case had I not have been stopped I could have been driving for another 3 years on a revoked licence, menaing my insurance was invalid. The court have since advised me that they advised the DVLA and this is where the fault lies.

Thanks

Welcome to the forum, Leanne. Do take up our legal adviser Lucy's offer of help.

I think you might get more sympathy if you could explain your logic in not using a hands-free kit after you were prosecuted the first time. To my way of thinking, the inevitable lack of concentration and control could result in someone's injury or even death (and has in the past): if that had happened, others would have far more cause to be 'outraged'.

Sorry if that sounds pompous, but as a father and grandfather I feel that quite strongly.
