Other party has insurance but expired CBT - Hopefully

I was hit by someone driving a 125cc bike, he admits fault and is insured but I have found out (from his mum) that he has an expired CBT. What is the likely outcome of this?

A) I end up having to claim through my insurance

B) His insurance pays and tries to recover costs from him

C) It rains for 40 days and 40 nights and unicorns become extinct

This happened to me today, police were called and he had to goto hospital my car was deemed unsafe to drive as the rear window was smashed and 'recovered' to a garage. Before I call my insurance company up etc I was wondering where I stand legally with this foolish kid.
