Uninsured driver - Monika

A friend of mine was driving my car without my permission and insurance when police stopped him. He called me explaining what he had done and that the police wanted to remove the vehicle.

I run out of the house as it was only round the corner and spoke with the police explaining that I was the registered keeper of the vehicle. I confirmed that he wasn’t insured on my policy and that I didn’t know that he had taken the car. I also explained that the car was registered disabled due to my terminal illness.

I wanted to take the car and drive it back to the house but police wouldn’t let me. They said they didn’t want to arrest my friend, instead they removed the car.

I had to go to 3 different places to retrieve the car and pay for its release.

Why would they not arrest him and take the car instead? Why would they punish me and fine me £150?

They are unlikely to arrest an uninsured driver. The normal procedure now is to confiscate the car and either issue a fixed penalty or deal with it by a summons to court.

The chances are they thought you may have been complicit in the driver using the car but there was not enough evidence to prove this. Had they have thought there was you may have been charged yourself with "permitting a driver with no insurance.

You sound like you know the person concerned. These cases often involve relatives. If you wish to push the case then you could press charges on the theft of the vehicle in which case you might recover the £150, which is not a "fine" but is a cost for the lifting and storage of the vehicle.
