A private seller has no responsibility to disclose unless asked.

Under the Consumer Protection Regulations a dealer would have to disclose if they knew. If they did not know then they would arguably be in breach of their "due diligence" requirement to check the vehicle with the registers.

But if the write off was not on the registers then there is probably no duty on a dealership. Be aware that many vehicles are "written off" for economic reasons and then repaired to a perfectly acceptable standard.

Many write-offs are not recorded.

Company A has 3rd party only insurance on fleet - car is badly damaged - it can be sold and repaired and there will be no history of this as it has not gone through an Insurance Claim.

I worked for several companies that "self insured" - the last one (2004) was paying £600+ for an Astra sized car - 3rd party F&T only! Comp was apparently in excess of £2000 / year - on 1000 cars a fair wedge.
