I was wondering what the contractual position is with regards to parking in a private residential car park.

Signs around the car park say "no unauthorised parking else you will be charged £75".

My tenancy agreement does not reference parking at all, but there is a parking policy that is given to residents when they move in. Where is the contract in this case? Is it the sign, or the parking policy? The sign does not refer to the parking policy.

The signs would probably need to be better than that to be enforceable but if you are a tenant they will probably be backed up by the parking policy.

The problem with the current set up is people who are not tenants could probably get away with parking there because the signes are possibly unenforceable whereas if the parking policy is properly written tenants could not.

The parking policy says "failure to comply" will result in a "penalty parking fine", though the amount isn't specified. Presumably that means contractually that clause is invalid due to it being penal?

Actually, the policy also doesn't even refer to parking outside a marked bay, and only refers to visitor bays. I see a lot of people (presumably visitors) just pull up on the side of the development, and some end up with tickets. So I guess parking outside of a bay is also pretty difficult to enforce as well?

If I was being asked to bring a case against you I would advise them not to bring it.

Thanks Lucy. I shan't worry about it then. My housemate also got a ticket too because her pass flipped over, and she is stressing about it. I'll pass on the message.
