My 2 year old golf suddenly caught fire in my drive on returning from my local town. I barely had time to rescue my dog from the back before the car burst into flames. I called the fire brigade but by this time the vehicle was a burnt out wreck.

Because the exact cause can't be proven due to severe fire damage Volkswagen are refusing to replace the car. The overwhelming cause is likely to be a mechanical fault (according to insurance engineer) and therefore VW should honour their warranty (I am a previous owner of 8 VW's).

VW have been unpleasant and aggressive throughout and customer services haven't even acknowledged my letters. The fire left me shaken and upset and meanwhile I live miles from anywhere with no public transport and no car!

Any advice welcome.

Wow what a dreadful thing to happen - my commiserations. In all honestly I would have thought this situation would be really up to the insurers to sort out. Who insures you car? Whether it's mechanical fault or arson or whatever, if your car is damaged by fire then surely the insurers should be the ones finding you a new car and then seeking compensation from VW - not you? That's the whole point of having insurance in the first place, right?

If I were in your shoes - first thing I would do would be to read ALL of the small print in your insurance policy to make sure they are not taking you for a ride... If you can quote them parts of their own policy while on the phone to them it'll certainly help your cause.

Next step would be to take some legal advice (do you have a lawyer close to you or your family that can help out?).

Lastly at the risk of sounding trite I would consider trying to use the media to get some help or at least publiciy... the Daily Mail I'm sure would love to hear about this kind of thing. Jeremy Vine / Radio 2. Watchdog perhaps? (Although I'm not sure how interested they are in one-off things like this). I'm also pretty sure that What Car? Magazine used to have a page or a section where they helped readers out who had problems like this where either dealers or insurers were giving customers a hard time.

Hi Sara, I'm glad to hear both you & your dog are OK (apart fromn the shock of it all) which is the most important thing.

Slidejules is correct, the insurance should be sorting it out by paying you the write off value. If they can then retrieve any of this from VW then good for them.

So have you actually spoken to the insurance company? What have they said in response to your comments?

At the moment you've told us what VW have said and done but you haven't told us how the insurance company are behaving.

Firstly, glad there were no injuries.

But what are you doing worrying about a warranty 'claim' from the manufacturer? From their (VW's) point of view, you've got a burnt out car which could be from any number of causes & the car can't be reliably examined to find the cause - how could they re-imburse on that?

As others have said - let your insurer process this , that's what you pay for.

Cars,TVs, houses etc go on fire all the time.

Problem is worrying when it happens to you.

Maybe 5+ years ago Peugeot had problems of leaking water causing motor on radiator fan to go on fire, consuming a number of cars. This was on Watchdog, the problem identified and a recall issued.

If VW has dozens of people all reporting the same issue as the OP I am sure they would recall other cars on the road.

If the OP's car fire is a one off then there is no problem for VW and it is up to the insurer to cough up the car value.

As the engineer said, cause 'unknowable' - how can absence of proof of cause be defaulted to blame of manufacturer? Not logical old bean.

I've no idea why the original poster thinks this is anything to do with warranty, nor why she is contacting VW. The insurance company will pay her for the car.

I've never heard of a warranty that pays out if the car bursts into flames.

1. Insurance company pays owner for car under the 'fire' part of the insurance policy.

2. If insurance company thinks it a fault, they pursue VW to recover the cost.

It's not up to the car owner to do anything about pursuing VW.

..My 6 month old Bluemotion set itself on fire driving home in really bad snow conditions in December last year, I narrowly escaped as I couldn't find the door handle in the black smoke that filled the car, I managed to find the window button which was thankfully still working, catch a breath and get out, blue flames were coming through the glove box as I exited and it was shortly gutted. I have two kids. They weren't in the car thankfully.

I have had the same experience, after two forensic examinations a cause still could not be determined, but they did decide that it wasn't my fault and allowed me to stop paying for the vehicle 4 months after the incident as it was a lease car. The forensic examiner told me that cars were 'allowed' to go wrong. I have had no apology and have been referred to the lease car company to address any issues I may have who are equally unhelpfull. I undertook counselling for a while as I found myself being rather hyper vigilant and traumatised for a while, not helped by a fire brigade campaign at the time stating that it takes between 2 and 3 breaths of toxic smoke to be rendered onconcious..

I do trawls from time to time to see if any more fires have been reported on these cars, just wondering if there are any others out there with simular experiences?

I think the point a lot of people are missing is that isn't it better for VW to make good rather than have a claim against your policy ?

Did VW service the car? If they did in my mind then its a double whammy. I would shake the insurance company up and have them do their job, I.e get you back on the road with little financial loss. VW and their dealers should be ashamed be ashamed of thewir shabby treatment of you. Get legal advice as to the possibility of sueing them. Glad your dog is ok, better to lose the car than your dog!

Unfortunately Sara is one of those OPs who asks for advice but never comes back to tell us the outcome. This happened last October.

But the comments above are clearly right: car fires are an insurance job unless the cause of the fire can be PROVED to be a fault with the car. Otrherwise every wee punter would torch their car just before the end of the warranty period, make sure the car was totally gutted, and claim on the warranty. (I'm not suggesting that the OP, who sounds genuine, did that or even left a smouldering cigarette stub in the car - but she would have hads to prove that she didn't.)

Were the 2 bluemotions mentioned in the posts above 1.6 or 2L?? Glad the dog is ok and the offspring were not in the car. Can't see anyway VW will help you but the dealer who services your car and presumably supplied it could at least give you a decent deal on a replacement car....I know... very optimistic.

Citizens advice may be able to help, they can get you a solicitors appointment for peanuts. Your own insurance should sort it out and hopefully you have a courtesy car with your policy.
