Reported in The Times.
A well known celebrity chef get's pulled for driving the wrong way up a one way street - fails a breath test.
Further report a day or so later - he's not to be prosecuted due to a police "procedural error".
Excuse me? How does this work? Can we non-celebrities look forward to more "procedural errors" should we be unfortunate enough to require one?
FACT: said Chef being serialised in self same newspaper.
What's the story?

Aaaah, the cult of celebrity...
(did I spell that right?)

Something along lines of:-
He was "just over".
Back at the nick, some "plonker" forgot to tell him he could take a blood test as option.
Said advice is supposed to be mandatory.
No such advice, your brief has you away on your toes.

Bang on Trevor
If the machine at the PS records a reading of alcohol in your breath of 40 to 50 micrograms per 100ml then a defendant MUST be given an option of substituting with a blood or urine sample. Plod decides which IIRC.
Metpol didn't do this.
It matters not the fact that you can be completely blotto and legless but if all the i's are not dotted and the t's crossed on the procedure then your not prosecuted.
I think PU will confirm that this bit of legislation has more case law than any other.

Plod chooses?
What if you hate needles?

Then the Police Surgeon is called in and if he confirms a genuine aversion to the needle then urine sample given under supervision of course. Not a nice job.
Stop posting and get that motor sorted....

Would this help someone who was hoping to drop below the limit before the test by killing time?

Killing time can assist or have an adverse effect.
If you have been tanking it up then there is a chance the readings could be rising.
There again if you had tanked up and rested then the reading could be coming down.
Notable gentlemen B had a whole screed on this very subject if you search back.
MarkII Zephyr in black would suit you Sir?

"Zephyr in black?"
And there's me thinking all this time that the Brian Blessed ZV1
was YELLOW (because that looked whiter on B/W tv)!

Trevor
Wasn't that the Mark III?
Lancashire Constabulary being whiter than white, Zedvictor Wun was also white.

More case-law than you can shake a stick at. In fairmess local Police (non-met) are pretty good on this although the odd case does cause problems for them. I find that most of the time the defendant's version is less convinicing than the Police - I good tell you some right pearlers.
