Peugeot 206 CC - Insurance claim - Pancho

My wife's car was recently reversed into by a coach when she was stationary in the road (£2500 damage)allowing a car coming the other way to come by the coach.The coach driver admitted he had reversed into her at the time.

During the claim negotiations,her insurer(A.A.) said that no coach driver has any obligation to provide a statement on any accident he/she is involved in except to a Court of law.This is grossly unfair as it means that all claims against a coach company are not worth proceeding with unless independent witnesses are available.The A.A. has therefore instructed my wife to accept 50/50 liability as they will not pursue the matter through the Courts without witnesses.

Does my wife have any option?

I think I would spend some money on a short interview with a solicitor specialising in these matters or go and have a chat with CAB It is an outrage that ANY group of drivers should excluded from the "Exchaging of details" at the scene. What about the Small Claims track in the County Court to recover your losses?

Bus claims are always tricky as they are often self-insured and fight every one. It is also a lesson as to why you should never let your insurer handle any claim - but particularly a non-fault claim.
