Hi there, i'm new to this forum but I've found through browsing that it's full of people who know what they are talking about.

Today I finally picked up my new car from a company registered dealer. It's a 2001 1.9 diesel VW Bora tdi.

I drove it straight to work from the dealership, everything was fine, I put my foot down and I could feel the turbo kicking in. Driving home in the evening however, I noticed a sudden drop in everything, speed wouldn't go over 60 and my rev's remained low. (this happened while driving) From this site i've learned it's called a limp home model(?)

It's rather low on diesel at the moment and it had run out of diesel previously on a test drive. Could that be affecting it?

I'm kind of stuck what to do and as I work evening shift didn't have a chance to report it to the garage today.

what do you all suggest I do?

another thing that's interested me is that the seller said that VW store the service history of it's cars on-line, I haven't found any proof of this wile searching the web and haven't had a chance to contact VW due to the time of the day.

Thanks for the compliment, Oilrag! Nate - welcome. We are here to help and support each other in any way we can , and as you know can tap in to Honest John's expertise, which is what I suggest you do with your Bora problem.

Click on Ask Honest John (above) and have a look at FAQ no. 5 which covers this. It's a complicated area, but you should certainly expect that the dealer will do something about the most serious problems. Normally, though, you have to give them a chance to fix it.

Some problems might be expected in a 9-year-old car: the implied term 'satisfactory quality' under the Sale of Goods Act takes the age and mileage of a used car into account. However this seems a major fault and you should have recourse to the dealer.

Remember that if you decide, understandably, to flog the car ASAP, as a private seller you aren't bound by the implied term of satisfactory quality.

after some investigation, i've found the problem

the car was classed as a Cat C write off. the damage to the chassis was severe and it's repair is very badly done, it's an instant MOT failure, and as it was mot'd the week I bought it, not only is the garage who did the MOT in a lot of trouble, so is the seller.....

should be interesting when I confront the dealership about my car tommorow...

You said in your opening post that the seller was a dealership in which case you should reject the vehicle and refer the case to Trading Standards. You need to report the suspect MOT pass to VOSA.

as it's a bank holiday nothing is open at the moment, I'm currently waiting for the owner of the dealership to show up as he hasn't got there yet.

how long would it take for trading standards to do something? with work and other things I really can't waste much more time on being messed around by companies

A Cat C will not necessarily fail an MOT but it will if it is not fixed properly. Consumer legislation protects you if a vehicle has serious failings and any reputable dealer would take the vehicle back and refund you without the intervention of Trading Standards.

If you did need to get them involved it would normally be resolved in days rather than weeks.

thanks for all the help guys, hopefully this will all be sorted by tomorrow anyway. the actual damage is to the chassis, and it looks like its been repaired with blue tac, it looks very dangerous and should no doubt be an MOT failure, even though it was passed by the garage of the dealers choice.

The tax disk was fake and there was no paper work with the DVLA..
