A friend of mine has 6 points on his licence. He has just been "done" for doing 51 mph in a 30 mph limit. Is this an automatic 6 points and a ban? If so what are the chances of him being able to talk his way out of the ban? He has plenty of mitigation, i.e. employs 4 or 5 people. If banned, how long is it likely to be?

Six points already, and then caught doing more than two thirds over the limit.
I don't think there's enough asbestos in the world to make this thread flameproof, perhaps the OP should consider having it removed?

If he gets another 6 points, then the ban will be 6 months under "totting up".

Has he been done by a camera? May well be 3 points which will take him to nine. 11 is the threshold for disqualification.

There is a book advertised in the press claiming to give methods of challenging ANY speeding fine under all sorts of procedural haisplitting.... Vas the camera tested that day etc.... is its certification correct... I cant remember where to find it but it might be worth spending a while trawlin the internet etc. just in case it can be found.

Guidelines are limit +40% for an instant ban. So 52MPH in 30.
But he could still get 6 points for the offence meaning a 6mth ban which would be worse than a short ban for the offence on its own.
Complete guess - maybe the mags would realise the effect of giving him 6points (even if warranted by the speed) would be disproportionate, and might take his circumstances into account tooo, and therefore give him 5 points.
To the OP, it's kind of pointless us all guessing what might happen to your friend. I can imagine why someone would come on here themselves - it's kind of theraputic, but to do it for someone else? You can't pass on our comments with any authority, for we have none, and Mags can be very random!

The ACPO guidelines tinyurl.com/dzcep seem to indicate that below 50 (I'm surprised it's that high) in a 30 the offender should get a fixed penalty. At 50 and above that then it's a court appearance.
So based on that, then 51 doesn't sound like instant banning territory.

Boris talking about elected sheriffs, and thinking about some of the traffic taliban police we have, makes me think how popular it would be if the police just imposed points for speeding, with bans for more serious offences. It would prove that they are not just using speeding fines as revenue. Points are very very painful by themselves.
I think of some poor guy with a wife and kid goin gto work in an office, doing 34 mph on his way in, and losing £60, maybe a wholedays wages or more, after tax. That's food taken out of the kid's mouth! I hate those self righteous car haters.

Nothing self-righteous about it, its personal choice... if a person can afford to run a car properly on those sorts of wages and have a family and kids - which is very debateable, btw - then they should take more care to ensure they don't waste their money on things like fines which are easily avoidable.

34 does not normally mean points - ACPO guidlines = 10% + 2 mph, so it's 35/36 that gets a tug. Even then it's normally possible to avoid points by attending a speed awareness course.
