Large element of scare mongering. I'm pretty sure Councils have always had the power to appoint their own adjudicators. Use of the NPAS has been mandated by central guidance which is unlikely to change.

Any LA trying to "go it alone" would find itself subject to close scrutiny from all corners.

The scary thing is that PAs don't have to pin a ticket on your windscreen, they merely have to make a note of your number and you get a penalty notice in the post. How can you argue against that if one says he saw you parked illegally? His word against yours, and you know who will be believed.

what if you left yours upside down on the dashboard ?

and before all you cynics jump to point out potential fines for no road tax, these days the DVLA is online and the police / attendants can find out you're taxed on the spot .

if DVLA write threatening fines , just say it fell off - can't see a court convicting on this ??

The major worry is that up until now the parking attendant has needed to affix the ticket to the car or hand it to the driver (with a few exceptions such as some offences that can be covered by cctv, albeit the pictures redcorded prove the offence).

again up until now, many parking attendant have a digital camera and take pictures to ensure they have sufficient evidence of the offence..after affixing the ticket to the car

this new system is open to abuse because the attendant can say you were parked incorrectly and issue a ticket AFTER you have gone up the road, you not knowing what they're up to.

Many parking attendants are on or near the minimal wage and are mercilessly chased for targets and are often casual staff. How easy will it be for you to lawfully stop for a moment, drive off and then have an unscrupulous attendant book you for an infringement.

Who is going to believe you?........ What defence do you have in reality?... How will you stop the bailiffs who will be instructed by some faceless bureaucrat who couldn't care less if you are guilty or innocent?

What on earth is happening to this country, don't civil liberties count for ANYTHING anymore?

Trouble is, even if you're 'in the know' and reckon you're onto a safe bet..the temptation is to pay the ticket to 'make it all go away'.......and the powers that be know this don't they.

I read about these new rules the other day with a rising sense of alarm and horror. I don't park illegally, but it really worries me that a parking attendant could book me for a parking offence I haven't done, without even putting a ticket on the screen. I hope they have to take photos as evidence, otherwise how on earth can you prove you didn't park illegally?

It's shocking how this government is chipping away at our fundamental rights day by day, using motorists as the guinea pigs.

Whoever dreamt up these new 'rules' must live on another planet - (Oh, could have been any politician, then!!)

The number of appeals will surely increase astronomically, as corrupt wardens will just right down numbers of passing cars, as has been pointed out. And it will be their word against yours - how on earth can that ever be right?? For any other 'offence' there needs to be proof!!

I have had 2 cases where I have driven off before the warden finished righting the ticket, and yet both times the warden continued to process the case and I had to appeal. I won both times, of course, but each time the wording on the notification letter was something like "You comitted an offence, but due to a processing error, we will not be pursuing the matter" What the heck is that all about??

it's about attempting to pervert the course of justice in my book....and has happened to me. I rang the police headquarters in one constabulary, explained that the warden wasn't entitled to fill the ticket in and submit it after i'd driven off and what were they going to do to about the fraudulent submission of that ticket.....the end result was me complying with the 'nomination of the driver' form and the immediate cancellation of the ticket on the telephone,

with a promise that the warden would be spoken to...yeah right

how many other people would have paid up, not knowing how the system should work

i was sat in a parking bay on saturday waiting for a friend who was in a shop, a traffic warden approached my car , checked the tax disc (expires in 2008) and then started typing in to her ticketing machine, she could of at least asked me to move but no she just started inputting so i moved on, what ever happened to manners ? i could understand if my car was unoccupied ....morons!

under the old system, you'd drive round the block and come back to pick up your passenger...no problem, as you're available to move the car if it was causing an obstruction

under the new system the ticket would be in the post as we speak

Now had a chance to look at this in more detail. I cannot find the new regulations mentioned in the report on the OPSI website (though draft Representations and Appeals Regulations are there). An earlier draft of the General Regulations, on which there was a public consultation last year can however be found at tinyurl.com/yw27md {edit to remove full stop that was preventing link from working - DD}

Service of the PCN is covered by draft regulation 9. The normal method will be by placing the PCN on the vehicle or handing it to the person appearing to be in charge of the vehicle. Service by post (reg 10) is reserved for cases where enforcement is by camera or where there the CEO can show he attempted service under rule 9 but was prevented from doing so by some person. That is presumably meant to close the current loophole where the driver leaves the scene before the ticket is actually stuck to the car. It does not seem to open the door for the wholesale booking of the innocent by the corrupt. There is a proposed 28 day time limit from alleged contravention to service of the postal PCN (a similar concept to the time limit for safety camera offences).

What is worrying is the "get out clause" in draft rule 10(4)b where the PCN can be served out of time if the LA promptly ask DVLA for driver details but DVLA is tardy in supplying them.

Draft rules 15 to 18 cover provision for the adjudicators. They do not require the preservation of NPAS, but rule 16(2) effectively provides for it's continued existence. Rule 16(1) would seem to stop any authority "going it alone" - the requirement is for at least three authorities to act jointly. Scotland and Northern Ireland already have their own Traffic Enforcement Tribunals and no doubt the Welsh would want parity; but these draft rules are for England only.

Several provisions protect the qualification and independence of the adjudicators. As now, they will be required to have five years experience as lawyers. Appointments are for an extendable fixed term, and require the consent of the Lord Chancellor. Dismissal (or refusal to reappoint an the end of individual's term) also requires the Lord Chancellor's consent. I cannot find it now I'm pretty sure there's another reg. in the pipeline that adds the Lord Chief Justice or his nominee to those involved in a "sacking".

Any attempt to remove the right to an independent appeal would be vulnerable to a challenge under the Human Rights Act and could also re ignite the ?Bill of Rights? issue previously struck down by the Administrative Court.
