A friend recently got stopped for exceeding the speed limit, and went to the local cop-shop to pay her £60 and produce all documents. Obviously they held onto her licence, which she expected to get back with the points etc written on it. However, she was very surprised this morning when an unstamped envelope dropped through the letter box, containing her licence (hand-delivered by Plod?). No written endorsements/convictions on the licence, it's totally untouched, "as new"!

So, basically, do the Police not write on licences anymore? And don't they bother paying Royal Mail to deliver them back to their owners?!

Mine come off in 2 weeks time after 4 years.

How do I get them removed and why must I tell my insurance company next year, even though they are expired? Surely the Rehabiliation of Offenders Act applies?

You need to pay to get them removed too. My friend might not, as they seem to have forgotten to write them on(!!) When my mum got points a few years ago they also wrote in ball-point pen AE.

From what your friend has told yopu Greg something not quite right.

Sequence, in a nut shell, goes something like this.

Speed offence and stopped at time.
Where DL and docs not produced at time Provisional Fixed penalty issued to offender along with producer.
2 copies FPN to Central Ticket Office (CTO)(Police, mags Clerks copies) who send Mags Clerks their copy.

Later, DL and docs produced at Police Station.
DL seized ( receipt issued to act as proof) and details of other docs produced forwarded to CTO.
If all in order FPN confirmed and DL sent to Mags Clerks Office.
Payment sent to Mags Clerks office, who on receipt of payment or no payment made in 28 days and no Court elected - fine registered - DL endorsed by Mags Clerks office and DL returned. DVLA informed by Mags Clerks of points.

If on production of other docs offences disclosed then CTO will inform Mags Clerks Office who will cancel the FPN return it to Police for Court file process and also cancel any payment forwarded together with DL to offender without any endorsement.

So in your friends case one of two:

Mags Clerks have committed a boo boo in not endorsing the Licence, or

Other offences have been disclosed, matter referred back to Police, who will then submit file to CPS for consideration of prosecution of the lot and issue of summons.

I think to get your licence looking clean again then you have to send it off to the DVLA in Swansea, pay a fee and they will reproduce your now 'clean' licence. But why bother, does it really matter? My licence still shows the speeding endorsement I got back in 2000.

The reason you must still declare it on your insurance proposal (normally up to five years after the date of offence) is because insurance premiums are calculated on statistics and as part of their statistical analysis they want to know if you have been a naughty boy within those last five years. Its in a similar vein to them asking if you have had any non-fault collisions in the last five years too. If you have then statistically you are probably more likely to be involved in another mishap than someone who hasn't.

I seem to remember if you send it back for a change of address or soething like that they will remove expired points.

But it doesn't really matter now as the points are only on the paper bit and if you carry the other part rozzers don't generaly want ot see the paper half.

My wife had some points written in pencil.

Yep a change of address is free so do what i did - send my license to DVLA stating i'd moved (to parents house), license is received back without any of the old points on and then a few weeks later i simply moved back to my house and resent the license to DVLA to be amended.

To answer the original question, there is obviously a reason why they returned it unmolested, probably an error at some point in the process, I would slink away quietly and not ask any questions and take it as a lesson learnt.

As to why they chose to hand-deliver it who knows, who care ? Could be any number of reasons, the most mundane being that they didn't have easy access to the station franking machine !

Proves a point that poor old plod can't win, if they'd have posted it somebody would have been moaning about that as well. "Waste of taxpayers money blah de blah !"

No complaint intended PU - she told me the story and I was intrigued to say the least, so asked on here (don't have any points of my own yet). Have given her the same advice - just carry on as normal, and keep a clean licence! I was particularly intrigued by the personal delivery service - 32p for 1st class postage is far less a waste of taxpayers' money than getting Plod to double up as a courier :-/

Incidentally, earlier in the year, this friend also managed to get pulled for talking on her mobile phone only one day before the law made it a prosecutable offence. Such luck makes me envious - I doubt I'd ever get off on either count.
