A friend of mines sister had a bad car accident on friday evening, she is only been driving for about 3 months and she missed a red light. She was hit on front corner of passenger side of the car, it is possibly a write off, as police are involved what is the worst she could be looking at apart from a huge increase in insurance, I'd imagine she could get 3 points for driving without due care could it be worse?

IIRC if she gets 6 points she may have to re-take her test. Sorry to be the bringer of bad tidings - I hope she was unhurt.

It's possible if she admits jumping the red light so they do her for that and also driving without due care.

They'd only do her for either/or but at the same time, she could get 6 points and/or a disqualification for a due care too. (Incidentally a disqualification in lieu of points might be better because it wouldn't carry an automatic retest).

A disqaulification is a no no and as she is a new driver a disqual will require a retest anyway. Lets hope 6 points is the max she received but do we have the whole story. Was there a Taffic or red light camera on the lights. Employ a Lawyer sooner rather than later. Regards Peter

Assuming that she doesnt get banned with at least 3 points on her licence and a fault accident how big an insurance rise is she looking at

I'd suggest to her that she has some extra tuition to help her observation. Next time she misses a red light it could be an HGV coming the other way and she may not have the luxury of doing it again :-/

My youngest Niece was in a rather similar position, with similar worries about the possible outcome of the situation, last year.
Her case was slightly different in that she didn't actually have an accident, but she still had to attend court.

IIRC new drivers loose their licience if they get 6 points within the first couple of years. It looks like she'll loose her licience.

Looking at this accident, it does seem a little extreme. I am very sorry your daughter had an accident and I am glad everything is ok. That might not be the case next time though.
Based on what has been said, your daughters driving needs a lot of improvement. I would very strongly suggest her completing a pass plus course and then doing the IAM test before she starts driving again. I suspect she had other things on her mind, but there is never an excuse for bad driving.
But on the good point, this is very good experience to ensuring everyone drives ultra careful as you never know where the next car is coming out of.
Sorry for being whingy, its just it would be great if drivers understood that cars are killers if driven without due care and attention!!!

For a start is not my daughter is my friends sister and as for her driving needs a lot of improvement nothing has been said apart from making one mistake, yes a fairly serious one but to be fair we all make them.
What was asked was for opinions on what the possible outcomes could be for her, pass plus and IAM have already been suggested and if she does keep her licence she will be doing at least pass plus. Please do you have any further ideas as to how much troubke she could be in.

Has she been cautioned yet? Has she been asked to make a statement. At the stage of a caution she will be told what the charge the police are preparing.
The options are no charge (unlikely) Dangerous driving (possible it depends on the drivers actions and behaviour before the accident i.e. speeding prior to the lights), Due care and attention (the most likely - dont underestimate this charge, it can carry big big fines, 3-9 points, and the magistrate can consider a disqualification if they so wish)
A brief IS required. Required now to help keep the charge to due care, and at court hearing to barter down the outcome.

no she was unsure of where she was and from what i am told was concentrating on the car she was following due to her being in an unfamiliar area.

The process then is that the Police will make an initial decision to proceed against any number of offences, CPS may have an input. If she has been interviewed without a brief it's not the end of the world.If she gets a summons she can get a solicitor at that point.It's almost impossible to forecast a punishment (if any) there are too many variables, ot least any mitigation she may want to put forward.
