Hi,
Does anyone know the penalty should one be recorded running a red light at 58mph in a 40mph zone?
I have not committed the above offence, but know of someone who has. Please don't reply with comments suggesting the offender "deserves all they get / should be shot / locked up", as I know they have made an idiotic error.
I would be very grateful for comments from those who know where the law stands on the matter.
Thanks.

You say you know someone who has. Have they got the NIP? If not, 58mph is a very specific speed if you see what I mean.
I don't know about the law to be honest. I thought that 15mph + over the limit was court but I'm not sure about that - nor am I sure that they can do you for speeding as well as jumping a light.
I do know however that the photo will have the speed recorded on it. Sorry this isn't helpful. Someone else will undoubtedly know more.

Need to know what he is being charged with. If he has the "you can plead guilty by post" bit then he is up for three points and 60-100 quid. Tell him to take it gladly.
Appearing in court, jumping a red light at 18 mph over the limit takes some explaining.

Depends what boxes ticked on NIP. Could be classed as Reckless /Dangerous driving, Fail Conform to traffic light and or speeding. Depends on previous driving record, any mitigation-Finger up in the air job.

Presumably the speed he was doing meant he couldn't stop at the lights in any case.....

"Presumably the speed he was doing meant he couldn't stop at the lights in any case....."
To have stopped might have caused an accident?
|
There are at least two distinct offences here, the speeding offence and failing to stop at a red light. Also possibly careless or dangerous driving.
Cheers, SS

I assume he was caught by a 'red light camera'. I didn't realise that these clocked a speed as well as the red light offence.

On another page the name and shame display was very interesting. I remember when one of these was under testing on the M20 near Maidstone some years ago. My number plate was caught and flashed up, it was really embarrassing. The only odd thing was the other cars flashing past me. The limit was 50mph and I was clocked at 52mph!!!!!!!!!!!!!!!

Well the person in question only got 3 points......
|
Incredibly lucky. I was expecting at least 6.
Still, I'll bet he/she is going to be a little careful around that neck of the woods now.

What a joke, you get 3 points just for being 10% above the limit on an open road. This person got 3 points for running a red light at that speed and could have killed someone. Ridiculous. I'm not being high and mighty as I speed all the time but it just shows that proportional punishment does not really come in to it.
Oh and my mate got done 3 times in 2 days doing 48 in a 40 in a HGV on an open single carriageway after a stretch of dual where the limit was signed as 50 for cars but is 40 for HGV's, it is one of those new height sensitive camera's, he now has 9 points on his licence in 2 days, justice? I think not.
Everyone get's narked at HGV's doing 40 on single carriageways anyway.

"justice? I think not."
As I have said many times before - you get law, justice often has nothing to do with it.
