Anyone know the exact law regarding cabbies and seat belts?

My driver tonight wasn't wearing one and says he never does..

taxi drivers are legally exempt from seat belts it's a safety thing in case they are attacked by passengers (which happens a lot , i know) .

(ii) a private hire vehicle while it is being used to carry a passenger for hire;

Sorry i know its a very late response but it might be read by someone who might find it useful.

I have booked through xxxx many times and at times some taxi drivers have worn their seat belt and at times some havent.

I raised this question to the driver once and he said he was exempt and he did not have to and he said i could ask with the council which his company licence was registered with. So i was left to believe that it depends on the Council which issues the taxi licence.

It may have something to do with the safety of the driver. Im not 100% sure but im presuming it is.
