Querying a parking ticket - just a bloke
Hello All,

I recently recieved a "You havn't paid your parking ticket, so now pay double" letter in the post.

The letter claimed I had parked in a "Residents Only Bay".
I wrote back to the Authority concerned and explained that I hadn't paid it because I've never received a parking ticket in the first place. I did explain that it's true I work in the vicinity of the address concerned but have access to private parking less than 15 minutes walk from the location of the alledged offence, at the time they quote I am normally driving home along the M25 and tehre is nothing in my diary to suggest that date was any different.

They have written again and this time say that I've provided no proof that I wasn't parked there ( True, but how can I prove I wasn't there? ) but if I send a copy of my Tax disc they'll reconsider my case.

So apart from re-iterating my case as previously, what else can I do?
Why do they need a copy of my Tax Disc? and surely I would be breaking the law if I were to make a copy of it anyway?

I know lots of people will always try and wriggle out of fines etc, but this really did come out of the blue and I havn't parked my car anywhere other than outside my office.


Any Ideas?

Just maybe that the TW who issued the ticket took certain details off the RFL displayed on the illegally parked vehicle (and I can see why.) Despite their faults haven't known DVLA to issue more than one Licence with the same serial number.

Not an offence to do what is asked (don't do in colour)and it may be your saviour.

Reply and see what road they go down. Your on a maximum so nothing to lose...

Ticket not actually issued but up at the office in Camden, London, we need to have the back of the building painted which involves scaffolding.
Scaffolders lorry turned up yesterday and by the time half a dozen poles were off along came a traffic warden with \"Shift it mate, or it\'ll cost you £50\".
Away went lorry.
Scaffolders are now negotiating for a dispensation to unload.
Are they expected to bring it on a bus or the underground or something?

I don't see how sending a copy of my tax disk will help... They already think it's my car and of course my unique tax disc will just confirm that yes it's the same car.

It's very annoying, if I had got a ticket I'd have paid the damn thing or disputed it, I certainly wouldn't have waited until it was doubled before taking action, what kind of an idiot does that?

Well, I'll send off the details and wait until the next response I get from them...

If, as DVD suggests, the registration was copied off the offending vehicle's tax disc, it won't be the first one to be wrongly copied. Some PO officials' handwriting is pretty illegible, especially if it has faded after several months in the sun.

Actually, the TW's round here use a barcode scanner and scan the tax discs barcode, thats why I can't see the point in sending my tax disc, the scanner must have misread the original barcode, and re-reading mine won't change their minds.

Oh well they may suprse me or this may just run and run....

If that's the case, then sending them the disc should do the trick. Reading barcodes through a windscreen is not an entirely reliable process, and this may be a tacit acknowledgement of that.

Incidentally, we recently got a parking ticket that mis-states the waiting period. We had still outstayed our welcome, but presumably the ticket has to be correct to be enforceable?

A parking ticket does have to be correct to be enforceable. I was fortunate to once escape a parking fine because the traffic warden had put the wrong date on the ticket.

Your plate may have been cloned, much less likely that your tax disc has been.

Often you cannot query parking tickets until after 2 weeks, by which time they've doubled in cost anyway. So not getting the original ticket may not have ended up costing you any more.

That always used to amuse me on sites... no-ones allowed on the scaffold until the H&S officer has checked and passed it for safety.... except of course the H&S rules don't appear to apply to scaffold monkeys :-) have you ever watched 'em scampering about errecting a scaffold????

All I got when my "case" was dropped was a letter saying that there had been a mistake noting the number asnd NFA would be taken...

I ended up abut £2.50 out of pocket for postage etc. not to mention the agrevation and worry it caused.

The tone of the letter was along the lines of, "you are obviously going to argue the toss with us and altho' we think you owe us this money we are not taking any more action."
As for any costs I've incurred well 3 1st class stamps should cover it but the aggravation has been considerable :-)

When the traffic warden gives a ticket he must record all information relevant to the ticket as per Road Traffic Act 1991. There are many technical/procedural requirements and one of them is that the parking warden must note down the car tax disc for it to be valid. The reason they are asking for your tax disc is because the parking attendant must have fabricated the ticket against your car when you were not actually parked there. If you were parked there then he would certainly have taken down your tax disc number. If he did not then the ticket is invalid even if you did park there. You should ask the Council to prove their allegation that you were parking there, and the starting point is to ask them for the tax disc number so that you can check it. So under no circumstance should you give your tax disc number, you should appeal on the notice to owner and if they reject it then fill in the form for appeal to the adjudicator and ask for the full case file. I dont believe that the council will reject your representation (if you make it the back of the NTO, ticking the box the contravention did not occur). If they do then if it goes to adjudication the Council will be in trouble and costs awarded against them. I was in the same situation and many times as website called www.unfairpcn.com helped me out. They are excellent. Check them out.

Link above does not work. Dubious about it being a requirement for the tax disc to be noted. Certainly practice in many areas as it protects both attendant and owner from variety of mistakes/malfeasances, but don't think it's a legal requirement.

Council has to act wholly unreasonably/vexatiously for costs powers to kick in and it's very rare indeed for adjudicator to award them.
