Dear all,

Odd sort of question, really. I live in a block of 10 flats, in a nice bit of Bromley. For our block, we have one parking space (although all flats have garages en bloc round the back), running lengthways beside the path up to the main door. The space is big enough for two small cars, if parked well, but usually accommodates just one.
I came home last week, and a car I didn't recognise was parked in the space, backed right to the end (so that another car could squeeze in). It may belong to a new resident, but I'm pretty sure it doesn't. Assuming it's dumped, what can we do (as it's private property)? It's an old E-plate BMW 3 series, sorry looking, but with tax til may. Any ideas would be helpful!

Section 3 Refuse Disposal (Amenity) Act 1978:

Where it appears to a local authority that a motor vehicle in their area is abandoned without lawful authority on ANY LAND IN THE OPEN AIR (your case) or any land forming part of a highway, it shall be the duty of the Authority to remove it.

Under Sect 2 it is an offence to abandon so.

Before LA can remove,it has to follow certain procedures under the Act and under the Removal and Disposal of Vehicles Regs, 1986, by fixing notices to advise a possible owner of their intention to remove. Used to be 7 days before action could be taken after fixing notice but if vehicle apparently abandoned and ought to be destroyed reduced to 24 hours.

So as a Council Tax payer of your fair city approach your L.A.

This happened to my son. He has 2 assigned spaces and an obviously abandoned Golf was left in one of them while he was away.

The police advised him to call the council. The council said they would send someone round after 7 days to fix a notice to the car. 30 days later that it could be removed.

The car wasn't locked so we pushed it up the road and left it in a layby. The next morning it had gone so someone must have thought it looked OK.

I accept that in doing this we then became car dumpers, but it had the desired result as far as we were concerned.

Am I missing something about abandoned cars, why can't the local government find out who owns them and then charge them to have them removed ?

After all the cars do have number plates, engine/chassis numbers.

You need to do something quickly as the normal scenario is abandon , strip all useful parts , break all glass ,match in petrol tank - black hulk, melted tarmac.

Are we talking ANY land in the open air? Pub/supermarket/private car parks?

Little job on at the minute on a pub carpark. Will save me looking it up. I was under the impression it was only pubic places but I will bow to your superior knowledge.

Section as set out in Stones covers two specific areas of abandonment:

(1) Any land in the open air, or
(2) any land forming part of a Highway

Nothing shown as a definition of "land in open air" so one must take it as face value.

You sure its dumped? You say you are not sure if it belongs to a resident. Dumped cars are not normally parked tidily or with any thought to other people parking, this one sound like it is. Dumped cars dont normally have road tax (why dump it if it has?)
Before you alienate some new resident (who may be 7 feet feet tall and built like a BSH) why not:

1/ Make enquiries with the residents (or leave a note on the car)
2/ Ask plod if the reg number is on the lost or stolen list.

Disagree - we've had a couple on my street of late that have been parked sensibly so as to not get in the way any more than necessary. These, however, have been cars where the owner is either unable to afford repairs or insurance and cannot afford to pay the have the car removed straight away.

Similar to above - if broken down or not able to pass MOT without work they cannot afford. If they don't have anywhere to store it off road then SORN is not an option so they have to keep it taxed until they can remove / repair it.

We've currently got an old Uno 'dumped' on the street by someone living further along. Quite why he couldn't dump it outside his own house I don't know and while he insists he is going to get it moved, it's been there over 2 months now and is getting a tad annoying as parking is difficult at the best of times. However, as he is a neighbour and a decent chap I have no intention of getting the L.A. as I don't want to cause hassle unnecessarily.

As for the original poster - I'd give it a week or so to see if it might not be just the friend of a resident who needed somewhere to leave it for a while and if it's still there maybe contact L.A. / leave a note in it.

It may well have been stolen by joy riders.

We used to get this from time to time in our road in Leicester.

When a car turned up that we didn't know we reported it to the Police and in the case of it being stolen, the owner would be contacted straight away.

In this way, we stopped our street for becoming a favourite for stolen cars to be dumped. The pondlife simply took to taking them elswhere - fine by us.

The VED may remain intact as to apply for a refund you need an address, easy for the Police to trace.

In any case, unless you know for certain whose it is, contact the police and tell them that it may be causing a nuicance.
