This is almost too hard to believe, but it's a true story.

I bought a used car from a 'dealership' (I use that word lightly). There were some alarm bells ringing that I ignored in favour of a deal—namely, the mention of spares and repairs on the contract (I know now what this means, but they let me test drive it and let me drive away with it with a children's seat in the front, so I'm fairly sure my consumer rights would have been intact).

As soon as I got on the motorway home, the car suffered a catastrophic failure. Smoke out the back, smoke out the front, wild vibrations, things falling out from the engine onto the road. I pulled over on the hard shoulder and, three hours later, had a tow truck bring the car back to my house.

I was gearing up for a fight with the dealer this morning; went to take my kid to school, and the car was gone. No word of a lie. I've reported it to the police and I'm about to speak to the insurance company (they will probably have just as hard a time as believing it as I am).

I have some assumptions about what's transpired here (pretty easy to jump to conclusions) but I'm going to let the police do their job (or not).

I thought I understood my consumer rights pretty well, but I'm confused about whether I have any legal recourse without the vehicle. Could I still take them to small claims court? I have a trail of evidence with regard to the fault. I recorded audio on my phone of the car breaking down on the motorway (at first it sounded like I vibration so I quickly opened voice memos because I thought I could send it to the dealer). My wife called the police to send out highway patrol as I was in a very dangerous spot. I have an invoice from the tow truck and so on and so on. But I don't have a physical car to reject or have fixed.

I would suggest that you speak with the Trading Standards Department of the area covering where the "Dealer" operates.

Presumably the car was insured against theft so it sounds like it being stolen was the best solution for you - claim back the purchase cost from your insurance and buy another car.

The fact you posted "highway patrol" leads me to think you're not in the UK.

It was insured, yes and I have logged it with the insurance company. I'm going to be out of pocket the excess, the admin fees, the increase in insurance premiums, the remaining 12 months of the policy etc. etc.

The dealer might argue that has nothing to do with them. I guess that's a fair argument. But if the car is recovered and completely wrecked (it was stolen in an almost undrivable condition), it becomes a very grey area, as I'm still entitled for the dealer to meet the costs of the damage present at the time of the sale or to reject the vehicle, no?

Wow, everyone has been super helpful here. Thanks. I spoke to citizens advice. They said if the vehicle is recovered, your right to reject still stands but it would probably have to be done in conjunction with an insurance claim, so there is no point.

Just doesn't seem right that a dealer can sell a car that nearly kills a bunch of people on the motorway with an obviously shady MOT and because the car is then stolen in a seemingly unrelated incident, is absolved of all responsibility.

I've reported it to Trading Standards. Doubt anything will be done about it, like everything else in this country.

I cannot see how there can be any right to reject if the car was advertised Spares or Repair. It means exactly as written on the tin.

Apprently it's to do with Section 75 of the Road Traffic Act, which it is an offence to sell or supply an unroadworthy vehicle. They would need to take all reasonable action to ensure that I knew the car was unroadworthy and that I was not going to drive the car. The car would have to be clearly advertised that the car was unroadworthy (it wasn't), they should have declined a test drive on public roads and they should have insisted the car was towed out of the lot - not watch me put my child's seat in it and drive off. All they did was slip a hand written comment on their standard contract.

I'm being deliberately vague because I believe the seller played a role in the car being stolen, there is an ongoing investigation and I don't want to be sued for defamation. Let's say it was a AMG A45 S

This IMHO could be used by the seller in his defence that the car was not actually road worthy and it was your own decision to drive it away.

If the insurers discovered that an unroadworthy vehicle was being used they would probably cancel the cover and refuse to pay.

The Police would also have a interest in an unroadworthy vehicle being driven on the road.

And don't forget that an MOT is not proof that a vehicle is road worthy, any number of things can happen to it within minutes of leaving the testing station that could affect its safety. You do not say in your posts how much MOT it had.

Think you would be wise to keep quiet and simply allow the insurers and police to pursue the matter and only give the bare information needed i.e. it blew up on the way home, it was recovered to your address and then it was stolen.

Sounds to me like it was stolen, recovered and badly repaired but with no car to prove it just let it go and learn. Its the type of car that the "dealership" you bought it from will use to take the money from an unsuspecting punter.

Thanks. I’ll take this under advisement. Makes a lot of sense. Although I will say that they were both implicit and explicit that the car was roadworthy and that the only reason for adding it to the contract was due to a light they could not clear. They had just put a fresh 12 month MOT on it And the advert on auto trader made it clear that there were a number of superficial problems but that’s it was a “excellent runner”.

All that said, your advice still makes sense

A disreputable dealer will put "spares and repairs" on an invoice in an attempt to avoid their statutory obligations to the buyer. If it is not mentioned in the sales publicity it might not be enforceable.

That sounds to me quite a possible scenario. Maybe this car has been botched together more than once ? The 'dealership' sells it again, effectively to each punter's insurers .... Just as long as no-one else finds it.
