i own a garage, about 4 years ago a nissan navarra was brought in owner had cooked the engine

he left me his contact details , i sourced a second hand engine, gave him a price and he gave me the go ahead, fitted engine spoke to him to let him know it was done and since then nothing,

When i call him phone rings out have left messages on answerphone and texts but no response. last week DVLA clamped it beca8use there is no SORN on. Like an i**** i paid to get the clamp removed and tried to contact the owner again with no luck.

enough is enough what are my rights regarding selling the vehicle to recover my losses and what do i have to do. All i have are the owners first name a mobile number that gets no reponse

This has beeen ongoing for 4 years?

You have no address only mobile, that being the case contacted DVLA for reg owner details?

Then sent a recorded delivery mail to that reg address?

Presumably because it was parked on a public road. Would expect a trader to know better.

Apply to the DVLA for a new V 5 in your name . They will contact the current owner to see if there is any interest in the vehicle. If they get no response, you get a new registration document in your name and you’ll be free to do whatever you want. Just keep a record of all your actions.

I would go along with that suggestion, but, additionally inform the local police of this action to cover yourself for any repercussions. They may just pay a visit to the Registered Keeper and offer you some guidance.

thanks hoefully DVLA might already be trying as i am sure they will want the back tax

It's not the trader's issue. The owner should have SORNed it as it will not have an MOT and also not be taxed.

car parkeed on land belonging to the garage but not fenced off i arrived in on a saturday to find it clamped, its not my job to SORN it but, while its in my possession i am responsible for it, had the DVLA removed it that could have been a huge headache. also i still cannot SORN it as i am not the keeper hope DVLA now chases him for back tax he may respond

As there have been no responses, do we know that this Keeper is still in the UK - or even still alive for that matter ?

will do, didnt think DVLA would supply any information like that due to data protection, so thats got to be worth a try
