Hi all had first accident in 2years of trouble free driving, just finished 2year new driver probation as well, sods law eh??. I was going round a mini roundabout the sort you see in all the retail parks, indicating right was about to exit when BANG car hits me on drivers side door. Car had no lights on just reversed and sped off. Drivers door badly dented but able to shut it can only open from the inside. Chassis were teadplates go looks very distorted and frame on lower edge of car out of shape. Doors out of line obviously but car driveable. Got reg of other car and went to police, car used locally in various crimes they cant do owt unless driver caught at time. Looks like i have lost ncb for something i was not at fault for. Do you reckon the car is a right off?? Glad i am ok just fed up that the honest motorist is the one that pays AGAIN for the plebs. Luckily had two witnesses. How long do these things take to sort out just worried because looks like my ins co wont be able to trace other driver.. Any suggestions much appreciated

The Police are wrong here, they may have tried to "cuff" it. Without knowing( or wanting to know here!) the layout of this particular road, it is more than likely a Road Traffic Act road where RTAs are reportable. The Police guidelines (nationally) are pretty clear they should try and trace the offending vehicle. There may be a public CCTV footage of the bump as well which has a time limit on it so this needs to be pursued. There may be private CCTV coverage, don't be fobbed off, they are as legally obliged (don't you just hate the recent trend of saying "obligated" - hideous Americanism) under Data Protection Acts to provide access to you of your own images. This need sorting go back to old Bill and see a supervisor there.PS current CPS guidelines require a witness (or two. DVLA will provide you details of the car for a small fee if you show cause for requiring.

PU is a qualified solicitor. Take his advice and follow it through with the Police Sergent or Inspector, and try to establish a witness. This is probably among the best advice you'll get on this forum
If you do get the details of the other driver, then a special delivery letter demanding reimbursment of costs quite often puts the wind up them and produces a result.

The 1991 Road Traffic Act amended the 1988 Act for driving offences to include road "or other public place" which brings in Retail Parks etc for offences.
As PU's usual excellent advice states go back, demand to see the
the Senior Duty Officer and insist this matter be recorded and investigated. There appears to be at least a due care and a certain fail to stop/report.
You can supply the VRM from which they can trace the Reg Keeper and then then the driver.
Would have thought that if it was on their books as used by an iffy they would have been more than pleased to get at them.
If you feel you are still getting the runaround insist on making an official complaint Negligence of Duty through lack of action.
In the meantime familiarise yourself with the work of the Motor Insurers Bureau (use as Keyword)for Web Search. You may still have a claim on them for your damages if Police fail to establish a driver.

Few more details forgot to add. Accident happened at night approx 9pm. Dialled 999 straight away no police attendance because no injury to me just damage to car. Where do i stand over the finance? car on 4yr 0% finance just paid over 1/2. Got 2 yrs to go approx £2800 to pay car prob worth less, car is citroen xsara x, s reg. If the repair is going to cost over a grand will they scrap the car and end the agreement. Sorry for all the questions just got a lot on. Thanx all

Sorry for the confusion reported it via 999 they rang back said ok to leave scene. went to local cop shop filled all forms in said failure to stop by other driver will be investigating further they said, just got insurance run around now

Hate to put a dampener on this but your description of your accident sounds exactly what happened to my son in a Cinema/fast food/bowling complex a few years ago. His two witnesses were security guards outside a bar. The car that hit him was a taxi. Witnesses said at the time that the taxi drove straight into him when it was his right of way. Good eh? Except that when the insurance company contacted the witnesses they had strangely changed their story to my son having driven out in front of taxi causing the accident. Son's "pride and joy" (he was a student and had worked v. hard in holidays to save up for it) Renault 5 was "written off" for about £150. Always wondered whether taxi driver had given witnesses a few quid which was cheaper than his insurance excess would have been. But then my son didn't feel like challenging the honesty of two "bouncers". (Nor did I! and to proceed throiugh courts would have been rather expensive and probably a waste of time - word of 3 against 1).
